AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS,
ORDERING A SPECIAL ELECTION TO BE HELD ON THE 3RD DAY OF NOVEMBER,
2009, FOR THE PURPOSE OF VOTING ON A PROPOSITION FOR ISSUANCE OF
DEBT TO REHABILITATE THE HUNTSVILLE PUBLIC LIBRARY, TO VOTE ON THE
EXCHANGE OF PARKLAND, AND FOR THE ADOPTION OR REJECTION ON
PROPOSED AMENDMENTS TO THE EXISTING CITY CHARTER OF THE CITY OF
HUNTSVILLE, TEXAS, AS AMENDED; APPROVING AND ADOPTING RESOLUTION
2009 -24; DESIGNATING THE PLACES AND MANNER OF HOLDING THE ELECTION;
AND PROVIDING FOR THE POSTING AND PUBLICATION OF NOTICE; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Huntsville, Texas, in the exercise of the discretion reposed in it
by the Constitution and laws of this State, and in accordance with the provisions of Chapter 9 of the
Texas Local Government Code, and in accordance with its City Charter has determined to: (i) submit a
proposition on a debt issuance for the Huntsville Public Library Renovation and Expansion Project; (ii)
submit a proposition for the exchange of City parkland for property owned by the Texas Department of
Criminal Justice; and (iii) to submit for adoption or rejection amendments to the existing Charter of the
City of Huntsville, at a special election to be held to be held November 3, 2009; and
WHEREAS, the City Council hereby approves and adopts the calling of a bond election for the Huntsville
Public Library Renovation and Expansion Project by separate resolution, numbered 2009 -24 attached
hereto as Exhibit "A" and adopts the Proposition and Ballot Language in said resolution. Resolution
Number 2009 -24 shall hereinafter be referred to as Exhibit "A ".
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE,
TEXAS, that:
The facts and recitations contained in the preamble of this Ordinance are hereby found
and declared to be true and correct.
SECTION 1. A special municipal election of the City of Huntsville shall be held between the hours of
seven (7:00) o'clock a.m. and seven (7:00) o'clock p.m. on the 3rd day of November,
2009, for a bond proposition as contained in the attached Exhibit "A ", for a proposition for
the exchange of parkland, and for adoption or rejection, proposed amendments to the
City Charter of the City of Huntsville, Texas.
SECTION 2. The City is hereby divided into seven (7) election precincts. The polling places for these
election precincts shall be as follows:

SECTION 3. This election shall be held in accordance with, and shall be governed by, the election
laws of the State of Texas. In all City elections, the Mayor, City Secretary or City Council
shall do and perform each act as in other elections required to be done and performed,
respectively, by the County Judge, the County Clerk or the Commissioners' Court.
SECTION 4. The form of the ballot for the election shall be as follows:

SECTION 5. PROPOSITIONS 1 AND 2
INSTRUCTION NOTE: (NOTADEINSTRUCCION):
Vote for or against the following propositions regarding the issuance of general obligation bonds and the
exchange of certain "parkland ".
PROPOSITION 1
Shall the City Council of the City of Huntsville, Texas, be authorized to issue the bonds of the City, in one
or more series or issues, in the aggregate principal amount of $3,500,000 with the bonds of each such
series or issues, respectively, to mature serially within not to exceed thirty years from their date, and to be
sold at such prices and bear interest at such rates, as shall be determined within the discretion of the City
Council, in accordance with law at the time of issuance, for the purpose of constructing, acquiring,
renovating, expanding, improving and equipping existing Huntsville Public Library including any
necessary demolition, constructing necessary infrastructure and parking facilities and other related costs;
and shall said City Council be authorized to levy and cause to be assessed and collected annual ad
valorem taxes on all taxable property in the City in an amount sufficient to pay the annual interest on said
bonds and provide a sinking fund to pay the bonds at maturity?

Shall the City Council be authorized to exchange 1.45 acres of the Eastham- Thomason Park Property
located at the Northwest corner of Eastham- Thomason park fronting Smith Hill Road for two parcels of
totaling 1.3 acres owned by the Texas Department of Criminal Justice (TDCJ) to correct a boundary
overlay resulting from an incorrect metes and bound survey which resulted in portions of City of Huntsville
parkland (1.45 acres) to be inside the fence line of the TDCJ and portions of TDCJ property (1.3 acres) to
be inside the fence line of the City of Huntsville Parkland?

SECTION 6. PROPOSED CHARTER AMENDEMENTS
AMENDMENT 1. Amending Article VI, Section 6.01 to provide that the regular city general
elections shall be moved from the uniform election date in May to the uniform election date in
November to be effective January 1, 2010, and that all Councilmembers -at -large shall be elected
on even numbered years beginning in November 2010 and Mayor and Councilmembers from all
Wards shall be elected on odd numbered years beginning in November 2011, the effect being
that current Councilmembers -at -large will have their current two year terms extended six months
until November 2010 and the Current Mayor and Councilmembers from all Wards will have their
current terms extended six months until November 2011, so that Section 6.01 shall read as
follows:
"Regular City general elections shall be held on the uniform election date in November to
be effective and starting January 1, 2010. All Councilmembers and the Mayor shall be
elected for two year terms, provided that the Mayor and Councilmembers from all Wards
shall be elected on odd numbered years beginning in November 2011 and all
Councilmembers -at -Large shall be elected on even numbered years beginning in
November 2010. In all odd year elections, each qualified voter shall vote for not more
than one candidate for Mayor and for not more than one candidate for Councilmember
from the qualified voter's ward. In all even year elections, each qualified voter shall vote
for not more than one candidate for each of the four Council -at -Large positions. Each
election shall be ordered by the Mayor, or in the event the Mayor fails to do so by the
Council. The City Secretary shall give notice of such election by causing the notice to be
published at least forty days prior to the date of such election in the official newspaper of
the City."
AMENDMENT 2. Amending Article IV, Section 4.07 to provide that special meetings of the city
council are allowed to be held at locations other than City Hall, so that Section 4.07 shall read as
follows:
"There shall be one or more regular meetings of the City Council each month, which shall
be held at such times and places as shall be prescribed by ordinance or charter. Special
meetings may be called at any time by the Mayor, the City Manager, or by a majority of
the Councilmembers qualified and serving by giving notice to the City Secretary. All
meetings of the Council, regular or special, shall be open to the public except as provided
by Chapter 551 of the Texas Government Code as amended. Regular meetings shall be
held at the City Hall of the City. The term City Hall as used in this Charter shall mean the
Council Chambers. The City Secretary shall give public notice of all meetings as required
by law."
AMENDMENT 3. Amending Article IV, Section 4.13 to provide that no ordinance shall be finally
passed until it has been considered and favorably acted on by the council at two (2) separate
council meetings and providing for exceptions to the requirement of two separate readings, so
that Section 4.13 shall read as follows:
The council may legislate and act only by ordinance, resolution or motion; and all
ordinances, resolutions or motions, except ordinances making appropriations, shall be
confined to one subject, which shall be clearly expressed in the title, and ordinances
making appropriations shall be confined to the subject of appropriations. The enacting
clause of every ordinance shall be, "BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF HUNTSVILLE. TEXAS'. Before any ordinance shall be adopted, the attorney for
the city shall approve such ordinance in writing as to form or shall file with the city
secretary written legal objections thereto. Every ordinance enacted by the council shall
be signed by the Mayor, however, should the Mayor refuse to sign or is unable to sign in
his or her official capacity the Mayor Pro -Tern shall act in his or her stead. Should neither
the Mayor nor Mayor Pro -Tem be able to perform any two (2) councilmembers shall sign
the Ordinance. Every ordinance shall be filed with and recorded by the city secretary
before the same shall become effective. Every ordinance shall become effective upon
adoption, or at any later time specified in the ordinance, except that every ordinance
imposing any penalty, fine or forfeiture shall become effective after the procedures in
Article IV, Section 4.14 of this Charter have been followed.
Except as otherwise provided in this charter, no ordinance shall be finally passed until it
has been considered by the council at two (2) separate council meetings unless the
requirements for reading it on two (2) separate days be dispensed with by the affirmative
vote of a two- thirds (213) majority of the Council qualified and serving. The requirement of
consideration on an ordinance at two (2) separate council meetings shall not apply and
only one (1) reading at one (1) council meeting shall be required for the final passage
of an ordinance relating to:
(1) The adoption or amendment of a budget;
(2) The assessment, levy or collection of taxes;
(3) The calling of an election or the canvassing of the returns and declaration of
the results of an election;
(4) An emergency.
In the event an ordinance is adopted as an emergency measure, the same shall be
expressed in the title and the body of such ordinance. The Council may adopt
emergency ordinances only to meet public emergencies affecting life, health, property,
or the public peace. In particular such ordinances shall not levy taxes, grant or renew or
extend a franchise, or regulate the rate charged by any public utility for its services.
Neither shall they authorize the borrowing of money, except as provided in Article XI.
After adoption, an ordinance shall not be amended or repealed except by the adoption of
another ordinance amending or repealing the original ordinance. Any member of council
may offer any ordinance in writing that he desires after it has been approved by the
attorney for the city as to form and has been placed on the agenda of a regular council
meeting.
An emergency ordinance shall be introduced in the form and manner generally
prescribed for ordinances, except that it shall be plainly designated in the title as an
emergency ordinance and shall contain, after the enacting clause, a declaration stating
that an emergency exists and describing it in clear and specific terms. An emergency
ordinance can be adopted with or without amendment or rejected at the meeting at which
it is introduced. The affirmative vote of at least two- thirds (2/3) of the members of Council
present shall be required for adoption. After adoption, the ordinance shall be published as
required for other adopted ordinances and shall become effective in the same manner.
Every emergency ordinance so adopted, except one authorizing the borrowing of money
as described herein, shall automatically stand repealed as of the sixty -first (61st) day
following the day on which it became effective, but this shall not prevent reenactment as
a regular ordinance."
AMENDMENT 4, Amending Article VII, Section 7.01 to change the required amount of
signatures to submit petitions for initiative by the people of the City to direct legislation to not less
than 1,000 of the qualified voters of the City so that Section 7.01 shall read as follows:
"The people of the City reserve the power of direct legislation by initiative, and in the
exercise of such power may propose any ordinance, except ordinances appropriating
money or levying taxes, or ordinances repealing ordinances appropriating money or
levying taxes, not in conflict with this Charter or the Constitution of the laws of the State
of Texas. Any initiated ordinance may be submitted to the Council by a petition signed by
not less than 1000 (one thousand) of the qualified voters of the City."
AMENDMENT 5. Amending Article VII, Section 7.02 to change the required amount of signatures
to submit petitions for referendum by the people of the City to approve or reject at the polls
legislation enacted by the Council to not less than 1,000 of the qualified voters of the City so that
Section 7.02 shall read as follows:
"The people reserve the power to approve or reject at the polls any legislation enacted by
the Council which is subject of the initiative process under this Charter, except
ordinances authorizing the issuance of either tax or revenue bonds, whether original or
refunding bonds, shall not be subject to such referendum. Prior to or within thirty days
after the effective date of any ordinance which is subject to referendum, a petition signed
by not less than 1000 (one thousand) of the qualified voters of the City may he filed with
the City Secretary requesting that any such ordinance be either repealed or submitted to
a vote of the people. When such a petition has been certified as sufficient by the City
Secretary, the ordinance specified in the petition shall not go into effect, or further action
thereon shall be suspended if it shall have gone into effect, until and unless it is approved
by the voters as herein provided."
AMENDMENT 6. Amending Article Vll, Section 7.07 to change the required amount of signatures
to submit petitions for recall any elected officer of the City of Huntsville to not less than 1,000 of
the qualified voters of the City so that Section 7.07 shall read as follows:
"The people of the City reserve the power to recall any elected officer of the City of
Huntsville and may exercise such power by filing with the City Secretary a petition,
signed by not less than 1000 (one thousand) of the qualified voters of the City demanding
the removal of such elected officers. The petition shall be signed and verified in the
manner required for an initiative petition."
AMENDMENT 7. Amending t he first paragraph of Article XI, Section 11.07 by deleting the
language "and shall be made only upon the recommendation of the City Manager" so that Section
11.07 shall read as follows:
"At any time in any fiscal year, the Council may, pursuant to this Section, make
emergency appropriations to meet a pressing need for public expenditures, for other than
regular or recurring requirements, to protect the public health, safety, or welfare. Such
appropriations shall be by ordinance adopted by the favorable votes of two-thirds of the
Councilmembers qualified and serving.
Should the unappropriated and unencumbered revenues, income and available funds of
the City for such fiscal year be not sufficient to meet the expenditures under the
appropriation authorized by this Section, thereby creating a deficit, it shall be the duty of
the Council to include the amount of such deficit in its budget for the following fiscal year,
and said deficit shall be paid off and discharged during the current fiscal year."
AMENDMENT 8. Amending Article XI, Section 11.13 to allow for the sale of bonds without the
requirement for publication or public sale, and to be sold in accordance with state law as
amended so that Section 11.13 shall read as follows:
"No bonds, other than refunding bonds issued to refund and in exchange of previously
issued outstanding bonds, issued by the City shall be sold for less than par value and
accrued interest. If any bonds should be bid at the direction of Council, the Council shall
have the right to reject any and all bids."
AMENDMENT 9. Amending Article XI, by adding a new Section 11,17 that provides for a
limitation of the Issuance of new debt that exceeds .002 (two - tenths of one percent) of the net
taxable value as certified by the Walker County Appraisal District applicable to the City tax roll for
the fiscal year in which the funds are approved (for reference purposes if 2009 net taxable value
was used the dollar amount would be is approximately 2.2 million dollars) and that Section 11.17
shall be titled and shall read as follows:
"Section 11.17. Limitation on Issuance of New Debt by City Council. Any new issuance
of new debt that exceeds the total of .002 (two- tenths of one percent) of the net taxable
value as certified by the Walker County Appraisal District applicable to the City tax roll for
the fiscal year in which the funds are approved shall be submitted to the qualified voters
of the City of Huntsville, Texas provided that the issuance of new debt is not required for
an emergency or disaster that includes the City of Huntsville as declared by the Governor
of the State of Texas or the President of the United States or an emergency or disaster is
declared by the majority vote of City Council only because of an imminent threat to public
health and safety. A favorable majority of all votes cast at the City election is required
for approval. "
AMENDMENT 10. Amending Article XII, by adding a new Section 12.03 and that Section 12.03
shall be titled and shall read as follows:
"Section 12.03 Tax abatement or rebate
A two - thirds (213) majority vote of the Council qualified and serving is required to
authorize any abatement of any city taxes or any rebate of any city taxes to any individual
or entity."
SECTION 7. The official ballots to be used in this special election shall comply with the applicable
provisions of the Texas Election Code, shall state each proposed amendment separately and distinctly so
that the voters shall pass upon each amendment separately and apart from another so that each voter
may vote `For" or "Against' any amendment or amendments without voting °Far" or 'Against' all such
amendments, and shall have written or printed thereon the following:

101, Huntsville, Texas 77340, is hereby designated as the place for main early voting for
the election. During the lawful early voting period, such clerk shall keep such place for
early voting open for early voting from 8:00 a.m. to 5:00 p.m. on each day except
Saturdays, Sundays, and official state holidays.
SECTION 9. The Mayor and /or the City Secretary and the attorney for the City are hereby authorized
and directed to make any filings required by the Federal Voting Rights Act. The Mayor
and /or the City Secretary and the attorney for the City are further authorized and directed
to take any action necessary to comply with the provisions of the Texas Election Code,

Ordinance, whether or not expressly authorized herein.
SECTION 10. The Mayor and City Secretary are hereby directed to give notice of the election by:
a) publishing the notice on the same day in each of two successive weeks, the first
publication not earlier than the 30th day but before thel4th day before election
day, in the newspaper;
b) by filing with the City Secretary, for posting, a copy of said notice at least twenty -
one (21) days before the election; and
C) by posting at City Hall and the Walker County Courthouse bulletin boards notice
of the election at least twenty-one (21) days before the election.
d) by publishing notice of the election in accordance with Chapter 9 of the Local
Government Code in a newspaper of general circulation published in the
municipality and the notice must include a substantial copy of the proposed
amendment; include an estimate of the anticipated fiscal impact to the
municipality, if any, if the proposed amendment is approved at the election;
and be published on the same day in each of two successive weeks, with the
first publication occurring before the 14th day before the date of the election.
The Mayor and City Secretary shall file with the City Secretary a copy of the notice as
published, together with the name of the newspaper and the dates of publication.
SECTION 11. That the Mayor and /or the City Secretary of the City of Huntsville are hereby authorized
to execute and /or issue, for and on behalf of the City , such orders, documents and forms
as may, from time to time, be promulgated by the Secretary of State of the State of Texas
in conjunction with the election herein ordained.
SECTION 12. The City Secretary and Mayor are hereby authorized to perform all duties and take all
actions as required by any joint election agreement(s) and /or the contract(s) for election
services and election agreement that may be authorized by City Council after the
passage of this Ordinance.
SECTION 13. This ordinance and the attached Exhibit "A" shall take effect from and after its passage.

C6digo de gobiemo local de Texas, y an virtud de sus Estatutos Municipales, ha decidido: (i)
presenter Is propuesta de emisi6n de clouds pare of Proyecto de renovaci6n y expansi6n de Is
biblioteca pubtica de Huntsville; (ii) presenter una propuesta pare el Intercambio del parque forestal
por propiedades del Departamento de Justicia Criminal de Texas; y (iii) presenter enmiendas pare
adopter a rechazar enmiendas a Jos Estatutos Municipales existentes de is cuidad de Huntsville
durante unas elecciones especiales quo se celebrar3n el 3 de noviembre de 2009; y
CONSIDERANDO QUE, of ayuntamiento aprueba y adopts mediante este documento Ia Ilamada a
una eleccibn de bonos pare at Proyocto do renovaci6o y expansi6n de is biblioteca publica de
Huntsville mediante una resoluci6n distinta, numerada 2009 -24 qua se adjunta a esto documento
coma Anexo "A" y adopts el Lenguaje de propuesta y papeleta de votaci6n de dicha resoluci6n, El
numero de resoluci6n 2009 -24 serd Ilamado de shore an adelante Anoxo "A ".
AHORA, FOR LO TANTO, EL AYUNTAMIENTO DE LA CIUDAD DE HUNTSVILLE, TEXAS, ADOPTA
qua:

ENMIENDA 1. Enmienda del Articulo Vl, SecciOn 6.01 pars estipular que las elecciones
municipates generates se moveran del die uniforme de las elecciones an mayo at die
uniforme de las elecciones en noviembre qua entrara an vigor at 1 de enero de 2010, y
qua todos los concejales en general deberan ser elegidos en afros pares a partir de noviembre
de 2010 y el alcalde y concejales de todos Joe distritos electorates deberan ser elegidos en afios
impares comenzando an noviembre de 2011, pars qua at mandato de Jos actuates concejales
an general se amplfe seis meses hasta noviembre de 2010 y at mandato del alcalde y los
conoejales actuates de todos los distritos electorates se amplie sets meses haste noviembre de
2011, por lo tanto to Secci6n 6.01 debera decir to siguiente:
"Las elecciones generates regulates deberan celebrarse an el die uniforme de las
eleociones an noviembre entrando an vigor y comenzando el 1 de enero do 2010. Los
concejetes y el alcalde seran elegidos pars mandatos de dos afros, siempre y cuando at
alcaldle y dos concejales de todos Jos distritos electorates Sean elegidos an altos impares a
partir de noviembre de 2011, y todos Joe concejales an general seen elegidos an once pares
a partir de noviembre de 201D. Durante las elecciones an afios impares, los votantes
cualificados no podran voter a mss de un candidato a alcalde o a mss de un candidato a
concejai de su distrito electoral. Durante tas elecciones an afios pares, Jos votantes
cualificados no podran voter a mss de un candidato a una de Jos cuatro posiciones del

ENMIENDA 2. Enmienda de Articulo IV, Secci6n 4.07 pare estipular qua Ias reuniones
extraordinarias de Is Ciudad se puedan cefebrar an otros lugares aparte del ayuntamiento,
por to tonic Is Secci6n 4.07 debera decir to siguiente:
" Deberan celebrarse una o mss reuniones regulates del ayuntamiento todos los meses,
qua se celebraran a la fora y on at lugar establecidos por to ordenanza c Jos estatutos. El
atcaide, el Administrador municipal o una mayore de Jos concejales cualificados y an
servicio pueden solicitor reuniones extraordinarias mediante un aviso al Secretario
municipal. Todas las reuniones del ayuntamiento, regulates o extraordinarias, estaran
abiertas al pablico a excepci6n de to estipulado an all Capituto 551 del C6digo de gobierno
de Texas y sus enmiendas. Las reuniones regulates se ceiebraran an el ayuntamiento de la
Ciudad. El tarmino ayuntamiento tal y Como so use en estos Estatutos significara las
camaras del consejo. El secretario municipal debera notificar al pablico de todas las
reuniones Como 10 dispone to ley.^
EN IENDA 3. Enmienda del Articulo IV, Seoci6n 4.13 para estipular qua no se sprobara
ninguna ordenanza de forma final haste quo consejo Is hays sido considerado y est6 de acuerdo
an dos (2) reuniones distintas del consejo y se hayan determinado exoepelones al requisito de dos
lectures distntas, por to tanto Is Serxi6n 4.13 debera decir to slguiente:
El consejo puede legfslar y actuar Onicamente, mediante ordenanzas, resoluciones o
mociones; y todas las ordenanzas, resoluciones o mociones, excepto las ordenanzas
pars asignar fondos, deberan limitarse a on terra, qua debera ser claramente indicado
an el titulo, y [as ordenanzas pars asignar fondos deberan limitarse all tema de la
asignaci6n de Tondos. La clausula de validez de todas [as ordenanzas sera
"DECRETADO POR EL AYUNTAMIENTO DE LA CIUDAD DE HUNTSVILLE, TEXAS ".
Antes de adopter ninguna ordenanza, at abogado de is ciudad debera aprobar dicha
ordenanza an cusnto a to forma o debera presenter por escrito objeciones regales a Is
misma ante el secretario municipal. Todas [as ordenanzas promuigadas por el consejo
deberan ester ffrmadas por el alcalde. Sin embargo, si el alcalde se niega a firmer o no
puede firmar an so capacidad oficial, el alcalde provisional actuary an so lugar. En caso
de qua ni el alcalde ni el alcalde provisional puedan realizar las funciones, dos (2) de los
concejales deberan firrnar Is Ordenanza. Todas las ordenanzas deberan ser presentadas
ante et secretario municipal, quien las registrars antes de qua entren an vigor. Las
ordenanzas entrartin an vigor tras la adopci6n, o an cualquier otro momento especificado
an Is ordenanza, excepto qua las ordenanzas qua imponen castigos, multas o
confiscaciones deberan entrar an vigor despu6s de seguir los procedtinientos del Artfcuto
IV, Secci6n 4.14 de estos Estatutos.
A menos qua se indique lo contrario an estos estatutos, no se aprobara ninguna ley de
forma final haste qua consejo is hays sido considerado y est6 de acuerdo an dos (2)
reunicnes distintas del consejo a menos qua los requisdois pars leeria an dos (2) dies
distintos se dispensen por medio del voto afirmativo de one mayoria de dos tercios (2t3)
del consejo cualificado y an servicio. No se aplicara al requisito de consideraci6n y
medidas afirmativas de una ordenanza an dos (2) reuniones distintas del consejo y solo
sera necesaria una (1) lecture an una (1) reuni6n del consejo pars Is aprobaci6n final de
one ordenanza relacionada con:
(1) La adopci6n o enmfenda de un presupuesto;
(2) La eveluaci6n, gravamen o recaudaci6n de impuestos;
(3) La liamada a elecciones o at escrutinio de los votos y is deciaraci6n de los
resultados de one elecci6n;
(4) Una emergencia.
En caso de qua se adopts one ordenanza coma medida de emergencia, se debera
indicar an el titulo y contenido de cliche ordenanza. El Consejo puede adopter
ordenanzas de emergencia Oniramente pars cumpiir con las emergencies pObficas qua
afectan a la vida, salud, propiedad o Is paz pOblica. En particular, dichas ordenanzas no
gravar8n los impuestos, otorgaran o renoveran o extenderan one franquicia, o regularin
Is tarifa qua cobra cualquier servicio pOblico por sus servicios. Tampoco podran der
autorizaci6n pars pedir dinero prestado, excepto segun to establecido por at Articulo XI.
Despu6s de Is adopter one ordenanza, no se pods enmendar o revocar excepto
mediante to adopci6n de otra ordenanza qua enmiende o revoque Is ordenanza original.
Cualquier miembro del consejo puede proporcionar one ordenanza por escrito qua desee
on vez qua haya sido aprobada par at abogado de Is ciudad an cuento a is forma y hays
sido anotade an to agenda de una reuni6n regular del consejo.
Una ordenanza de emergencia se introducirs de Is forma y manera generalmente
establecida pare las ordenanzas, excepto qua puede ser simpiemente designada an el
titulo comp one ordenanza de emergencia y debera contener, despu6s de Is cisusula de
validez, una declaracibn qua indique qua exists una emergencia y qua fa describe an
tdrminos claros y especificos. Es posible adopter one ordenanza de emergencia con o
sin enmiendas o rechazarla an Is reuni6n donde foe introducfda. Sera necesario el voto
afinmativo de al menos dos tercios (213) de los mlembros presentes del consajo pars
adopter fa ordenanza. Tres la adopci6n, is ordenanza debera ser publicada segun to
establecido por otras ordenanzazas adoptadas y entrars an vigor de Is misma manors.
Todas ]as ordenanzas de emergencia asf adoptades, excepto one qua de permiso pars
pedir dinero prestado tal y coma se describe an sate documento, sera rechazads
automaticamente an sesenta y on (61) del dia an qua entr6 an vigor, pero esto no evitara
so reintemretaid6n come ordenanza recular.
ENMIENDA 4. Enmienda del Artfculo VII, Secci6n 7.01 para modificar to cantidad de firmas
necesarias a no menos de 1000 votantes cualificados de la ciudad con el fin de clue la
gents de to ciudad presente peticiones de iniciativas pare legislar directamente, por to
tanto la Secci6n 7.01 debera decir to siguiente:
"La gente de to ciudad se reserva el poder de la fegistaCi6n directs por iniciativa, y an el
ejercicio de tai poder puede proponer cualquier ordenanza, excepto ordenanzas Para
asignar dinero o gravar impuestos, u ordenanzas que revoquen ordenanzas que asignan
dinero o graven impuestos, que no aslant en conflicto con estos Estatutos o la
Constituci6n de las leyes del estado de Texas. Todas las ordenanzas inicfadas se pueden
presentar ante el Consejo mediante una petici6n firmada por no menos de 1000 votantes
cualificados de la ciudad.
ENMIENDA 5. Enmienda del Artfculo VII, Secci6n 7.02 pare modificar la cantidad de firmas
necesarias pars que to gente de Is ciudad presents peticiones de referendums pars aprobar o
rechazar an las umas legisiaci6n promulgada por el consejo a no menos de 1000 de los; votantes
cualificados de la Ciudad, por to tanto la Seoci6n 7.02 deberd decir to siguiente:
"La gente se reserva of Coder para aprobar o rechazar an las urnas cualquier ley aproboda
par el Consejo que este sujeta al proceso de iniciativa bajo estos Estatutos, excepto Jas
ordenanzas que autorizan la emisi6n de bonds fiscales o de ingresos, tanto si son bonos
originales o de reflinanciaci6n, no estaran sujetos a dicho referendum. Antes o en trainla
dfas tras to fecha de entrada en vigor de cualquier ordenanza sujeta a referendum, se
puede presentar una petici6n firmada por no menos de 1000 votantes cualificados de la
ciudad ante el secretario municipal solicitando que dicha ordenanza sea revocada o
sometida a votaci6n por to gente. Cuando dicha petici6n hays silo certificada corn
suliciente por at secretario municipal, to ordenanza especificada en la petici6n no entrara
en vigor, o se suspenderan las medidas adicionales a partir de entonces si hubtera entrado
en vigor, hasta y a menos que sea aprobada por los votantes como se indica en aste
documento."
ENMIENDA 6. Enmienda del Artfculo VII, Secci6n 7.07 para modificar is cantidad de firmas
neceserias para presentar peticiones con el fin revocar cualquier funcionario electo de la ciudad
de Huntsville a no menos de 1000 de los votantes cualificados de la ciudad, por lo tanto to Secci6n
7.07 debera decir Jo siguiente:
" La gente de la ciudad se reserve el poder pars revocar cualquier funcionario electo de la
Ciudad de Huntsville y puede ejercer dicho poder mediante to presentaci6n de una peter
ante el secretano municipal firmada por no menos de 1000 votantes cualificados de to
Ciudad que exijan to destituoi6n de dichos funcionarios electos. La petici6n debere ester
firmada y comprobada Como to requiere una petici6n de iniciativa."
ENMIENDA 7. Enmienda del primer parrafo del Artfculo XI, Secci6n 11.07 borrando el ienguaje
"y se realizari unicamente bajo le recomendeci6n del Administrador de la ciudad ", por to que is
Secci6n 11.07 debera decir to siguiente:
"En cualquier momento de cualquier also fiscal, of Consejo puede, de acuerdo con esta
Secci6n, realizar apropiaciones de emergencia para satisfacer una necesidad urgente
por gastos pOblicos, para requisitos que no sean regulares o recurrentes, para proteger
la salud publics, la seguridad o at bienestar. Tales apropiaciones deberan reatizarse
por ordenanzas adoptadas segun el voto favorable de dos tercios de Jos concejales
cualificados y en servicio y deberb realizarse unicamente tras la recomendaci6n del
administrador de la Ciudad.
En caso de que las ganancias no apropiades y sin gravimenes, ingresos y fondos
dfsponibtes de la ciudad pare dicho afio Fiscal no sean suficientes para satisfacer los
gastos bajo la apropiacibn autorizada por esta Secci6n, creando por to tanto un deficit,
sera ta responsabittdad del Consejo incluir Is cantidad de dicho deficit en el
presupuesto del siguiente afio fiscal, y se saldarb y eliminara dicho deficit durance el
actual alto fiscal."
ENMIENDA 8. Enmienda del Articulo XI, Secci6n 11.13 para permitir la venta de bons sin
necesidad de publicaci6n o venta publica, y pare vendedos an virlud de las leyes estatales
y sus enmiendes, por to tanto Is Secci6n 11.13 deberla dedr:
"Ningun bono emMdo por Is cuidad, a menos qua Sean bonos de refinanciaci6n emifidos
pars reembolsar y a cambio de bonos pendientes previamente emltidos, podrA venderse
por menos del valor nominal a inter6s acumulado. Si $a subasta algOn bono por orden del
Consejo, at Consejo tendrA derecho a rechazar todas y code una de las pujas."
ENMIENDA 9. Enmienda del Art(culo XI, affadiendo una nueva Seccl6n 11.17 qua estipula
un ilmite pare )a emisi6n de nueva deuda que sobrepase 0,002 (at veinte por ciento de
un uno por ciento) del valor neto tributable tai y como to certifica Ia el Distrito de Tasaci6n del Condado
de Walker correspondiente al registro fiscal de to ciudad pars el aifo fiscal on que se aprueban los fondos
(como referencia si se use at valor tributable de 2009 Is cantidad an d6tares deberia ser aproximadamente
2,2 miilones de d6lares) y Is Secci6n 11.17 deberia litularse y decir to siguiente:
"Secci6n 11.17. Llmite de emisi6n de nueva deuda por el ayuntamiento. Toda nueva
emisi6n de deuda qua sobrepase al total de 0,002 (el veinte por ciento de un uno por ciento)
del valor neto tributable tai y Como lo certifica Is al Distrito de Tasaci6n del Condado de
Walker correspondiente at registro fiscal de Is ciudad pars el afio fiscal an qua se aprueban
los fondos serA presentada ante los votantes cualificados, siempre y cuando at gasto no sea
necesorio pare una ernergencia o desastre que Inciuye Is ciudad de Huntsville tai y corrno to
declar6 el gobemador del estado de Texas o el Presidente de Jos Estados Unidos c se
declare una emergencia o desastre por voto mayoritario del ayuntamiento solo por una
amenaza inminente a Is seguridad y salud pOblica. Se necesita una mayoria favorable de
todos los votos aftfidos an las eleccrcmes municipates pare su aprobaci6n."
ENMIENDA 10. Enmienda del Articulo XII, al o6adir una nueva Secci6n 12,03 y qua to
Secci6n 12.03 debe titularse y decir to siguiente:

SECCI6N 10. Por la presente se ordena al alcalde y secretario municipal a avisar de las elecciones:
a) publicando el aviso el mismo dia an dos semanas consecutivas, la primera publicacif
no antes de 30 dies pero con 14 dias de antelaci6n antes del dfa de las elecciones, e
el peri6dico;
b) presentado una copia de dicho aviso ante el Secretario municipal pars ponedo a Is
vista en un luger publico al menos veintiOn (21) dias antes de las elecciones; y
c) poniendo una copia an los tableros de anuncios del ayuntamiento y el Tribunal del
condado de Walker al menos veintiun (21) dfas antes de las elecciones.
d) publicando un aviso de las elecciones de acuerdo con el Capitulo 9 del C6digo de
gobierno local en un peri6dico de circulaci6n general qua se publique en el municipio
y el aviso debe incluir una copia sustancial de la enmienda propuesta; incluir un calculo
