MIN CC 10/26/2004n L� CITY COUNCIL MEETING OF OCTOBER 26, 2004 BOOK T' 173 Il MINUTES OF THE HUNTSVILLE CITY COUNCIL MEETING HELD ON THE 26TH DAY OF OCTOBER 2004, IN THE CITY II HALL, LOCATED AT 1212 AVENUE M IN THE CITY OF HUNTSVILLE, COUNTY OF WALKER, TEXAS AT NOON. j) The Council met in a special session with the following members present: i COUNCILMEMBERS: Steed Smith OFFICERS: Gary Crawford Bob Tavenner Kevin Evans, City Manager Mickey Evans Jim Willett Donna Welter, City Secretary Judy Kayse Mac Woodward Thomas Leeper, City Attorney Absent: Jack Choate CALL TO ORDER [NOON] Mayor Pro Tern Steed Smith called the special session to order. 'I PLEDGE OF ALLEGIANCE to US AND TEXAS FLAGS, INVOCATION Mayor Pro Tom Steed Smith led the invocation. STATUTORY AGENDA a. Consider and take action on upgrade of existing software and associated legal matters. Council recessed to Executive Session to discuss this item. EXECUTIVE SESSION [12:02 p.m. - 12:50 p.m.] Councilmember Kayse made a motion to adjourn to Executive Session and Councilmember Crawford seconded the motion The motion passed unanimously. The City Council conducted a closed session as authorized by Texas Government Code, Chapter 551, on the following matter: upgrade of existing software and associated legal matters. RECONVENE [12:50 p.m.] Councilmember Woodward made a motion to file a lawsuit in the District Court of Walker County against New World Systems and Councilmember Kayse seconded the motion The motion passed unanimously. MAYOR / COUNCILMEMBER 1 CITY MANAGER REPORT a. Considerand take action to approve Ordinance 2004 -10 -26.1 adopting Rules and Procedures forthe City of Huntsville City Council. No action taken. ELECTION OF MAYOR PRO TEM 'l Mayor Pro Tem Smith was absent from this point forward. Councilmember Woodward made a motion to elect Councilmember Crawford as Mayor Pro Tem and Councilmember Evans seconded the motion. The motion passed unanimously. b. Consider and take action to approve travel funds in an approximate amount of $2,000 for Councilmember Crawford to attend the NeighborWorks Training Institute in New Orleans on December 13 -17, 2004. Section 14.11 of the City Charter states that a Councilmember shall not be entitled to reimbursements exceeding $500 each for each fiscal year: however, it specifically provides that such limitations shall apply only to reimbursed expenditures and shall not restrict or limit the authority of Council to authorize expenditures by a Councilmember for such purposes in excess of such amounts prior to the time such expenditures are made. EXECUTIVE SESSION The City Council will conduct a closed session as authorized by Texas Government Code, Chapter 551, Section 551.074 - personnel matters regarding the election, appointment and /or duties of one or more officers and /or employees, including the evaluation of the City Manager.
