MINUTES OF THE HUNTSVILLE CITY COUNCIL MEETING HELD ON THE 23RD DAY OF JANUARY 2001, IN THE CITY

The Council met in a regular session with the following members present:

Mayor Green called the meeting to order.

PUBLIC COMMENTS
Kelly Barber. Mr. Barber stated that he had parked downtown to visit the shops and have a meal at The Texan. Upon
returning to his vehicle, he had a parking violation for exceeding the two hour parking limit. He asked why the City would
impose a two hour limit.
Mayor Green stated that the merchants in the downtown had requested the limits to keep employees in the downtown from
taking all the customer spaces. He asked that he visit with J. D. Schindler, Director of Community Services, about this issue.
CONSENT AGENDA
1. Consider minutes of January 9, 2001.
2. Approve Ordinance 2001 -01 -23.1 amending Title 20, Motor Vehicles and Traffic, of the Code of Ordinances by amending
Schedule IV, Parking Limit Zones,
3. Approve the purchase of the Octal 250 Messaging Service System from Avaya in the amount of $24,302.00, as budgeted.
Councilmember Howard made a motion to approve the ConsentAoenda, and Councilmember Erb seconded the motion.

STATUTORY AGENDA
1. Approve the Developer Contract with West Hills Park Joint Venture, and authorize the City Manager to sign the Contract
on behalf of the City.
On December 12, 2000, the City Council approved a developer contract with Tom Curtis and Home Depot to build a Home
Depot store in Huntsville on a tract of land adjacent to the proposed Parkwood Drive and Interstate Highway 45 West Feeder
Road. Mr. Curtis has returned to the City and informed it that he could not negotiate the purchase of certain tracts of land for
the original Home Depot site and that he now is pursuing a plan for Home Depot to build on a site north of the original site. Mr.
Curtis represents that he still has an agreement with Home Depot to sell it property for a store in Huntsville and that he will
close on or before April 1, 2001. Mr. Curtis has proposed revising the developer contract to accommodate the new Home
Depot site.
The revised Developer Contract requires the City to design and construct two roadways adjacent to the development site
rather than three as originally proposed. Those roadways are (1) the extension of Veterans Memorial Parkway and (2) West
Eastham Drive (shown on Exhibit "A' attached to the proposed agreement). As a result of the elimination of one street
extension (West Hills Circle) and the change from Parkwood Drive to West Eastham Drive, West Hills Park Joint Venture has
agreed to contribute $450,000 plus $150,000 when Home Depot closes on the propertytowards the design and development
of these roadways. The $450,000 will be escrowed afterthe Developer Contract is executed by the parties and the $150,000
will be paid in cash within three days of closing. In the event that Home Depot does not purchase the property, the City will still
construct the extension of Veterans Memorial Parkway with the $450,000 escrowed by West Hills Park Joint Venture.
In addition, the requirement to repay West Hills Park Joint Venture (Curtis) $100,000 has been eliminated. Also, certain
additional requirements concerning an off - premise sign and driveway access has been included in the revised agreement.
The City is not obligated to do anything until West Hills Park Joint Venture has escrowed monies in accordance with the
Contract. Staff recommends this revised contract because it is to the City's benefit to extend Veterans Memorial Parkway from
S. H. 30 to the 1. H. 45 West Feeder Road regardless of whether a Home Depot is developed on the property.

Council member Smith made a motion to approve the revised Developer Contract with West Hills Park Joint Venture. and
authorize the City Manager to sign the Contract on behalf of the City, with minor modifications handled by the City Attorney,
and Councilmember Martinez seconded the motion. The motion passed unanimously.
MAYOR ACTIVITY REPORT
Mayor Green updated City Council on various capital projects.
CITY MANAGER REPORT
1. City Manger Bob Hart introduced Shawn Lewis, Main Street Manager.
2. Discuss FIAT - Fiscal Impact Analysis Team. Mr. Hart stated that the City would aid in the legislative process by
providing input regarding various bills that involved cities.
