MIN CC 03/02/1999CITY COUNCIL MEETING OF MARCH 2, 1999 BOOK "S" 199 MINUTES OF THE HUNTSVILLE CITY COUNCIL MEETING HELD ON THE 2ND DAY OF MARCH, 1999, IN THE CITY HALL, LOCATED AT 1212 AVENUE M IN THE CITY OF HUNTSVILLE, COUNTY OF WALKER, TEXAS AT 5:15 P.M. The Council met in special session with the following members present: COUNCILMEMBER: William B. Green, Mayor Ron Lange Officers: Marjorie Rex Dave Liming Gene Pipes, City Manager Vance Howard David Martinez Danna Welter, City Secretary Dan Davis Steed Smith JoAnn Castille EXECUTIVE SESSION (5:15 p.m. - 6:25 p.m.) to discuss real estate acquisition - 7a' Street and Avenue M, pipeline right -of -way, arterial right -of -way, Elkins Lake property; and park property as authorized under the Texas Parks and Wildlife grant. CONSIDER LETTER AGREEMENT AMENDING THE TENASKA CONTRACT EXTENDING THE TIME TO ACQUIRE EASEMENTS FOR THE WATER TRANSMISSION PIPELINE Councilmember Rex made a motion to approve the letter agreement amending the Tenaska contractbv extending the Intern acquire easement for the pipeline and Councilmember Castille seconded the motion. The motion passed unanimously. CONSIDER ORDINANCE 99 -03 -02.1 DECLARING THE NECESSITY FOR ACQUIRING BY CONDEMNATION EASEMENTS ACROSS CERTAIN DESCRIBED PROPERTIES FOR RIGHT -OF -WAY PURPOSED FOR CONSTRUCTION AND OPERATION OF A WATER PIPELINE AND RELATED APPURTENANCES Councilmember Castille made a motion to approve Ordinance 99 -03 -02.1 declaring the necessity for acquiring by condemnation easements across properties forright -of -way purposes forthe construction and operationofa water pipeline and Councilmember Davis seconded the motion. The motion passed unanimously. CONSIDER AUTHORIZING THE CITY MANAGER TO ENTER INTO A FLEXIBLE REPURCHASE AGREEMENT WITH A PROVIDER AT A RATE TO EXCEED THE DEBT ISSUE RATE ON THE 1999 C.O. DEBT PROCEEDS FOR THE STREET ARTERIAL ($7,350,000) Councilmember Luning made a motion to authorize the Citv Manager to enter into a flexible repurchase agreement on the 1999 C.O. debt proceeds for the street arterial ($7,350.000). and Councilmember Rex seconded the motion. The motion passed unanimous) COUNCILMEMBER ACTION Happy Texas Independence Day. Councilmember Liming wished all of Council a happy Texas Independence Day.
