MIN CC 03/27/2007CITY COUNCIL MEETING MARCH 27, 2007 BOOK 'A 20 -ES OF THE HUNTSVILLE CITY COUNCIL MEETING HELD ON THE 27'" DAY OF MARCH 2007, IN THE Cl LOCATED AT 1212 AVENUE M IN THE CITY OF HUNTSVILLE, COUNTY OF WALKER, TEXAS AT 5:00 P.M. to Council met in a special session with the following members present DUNCILMEMBERS: OFFICERS: Turner Bob Tavenner Kevin Evans, City Manager ickey Evans Dalene Zander Danna Welter, City Secretary n Willett Mac Woodward Thomas Leeper, City Attorney Eck Choate Clarence Griffin alissa Mahaffey CALL TO ORDER [5:00 p.m.] Mayor Turner called the meeting to order. Authorize transfer of funds to the Tanyard Creek @ Old Colony Road Drainage project creating an availabl construction budget of $100,032, as presented by Steve Stacy, Director of Public Works. This project is necessary because of the failure of the roadway at the crossing of Tanyard Creek and Old Colony Road is to the poor condition of the existing drainage structure, a new drainage structure is required before reconstruction of th adway section. Old Colony Road is shown as a collector roadway as per the Transportation Master Plan. The structure wil designed and constructed as per the applicable standards. Also, this area is within the 100 -year flood plain and must b signed within all applicable requirements. This project has been deemed an emergency. Therefore, this project qualifies for an exemption to the competitiv Ming requirements according to Section 4 of the City of Huntsville Procurement and Disposition Policies and Procedure d Texas Government Code section 252.022 (a)(2) and (3). Staff has created a preliminary budget for this project. An amount of at least $100,000 is recommended. Because of th ture of this project, staff will report on the progress and monies expended in a timely manner. If funding problems occur , ty Council will be notified immediately. SCAL IMPACT/ FUNDING SOURCE: Fiscal Impact: $100,032 (reallocation of budgeted project funds) Funding Source: Budgeted Project Funds - transfers Pine Hill Road Sewer: 702 - 70201 -62300 Construction $90,032.00 (balance available) Unallocated Budget: 702- 999 -99999 $41,741 (balance available) Staff recommends transferring $90,032 from the Pine Hill Road Sewer Project and $10,000 from the Unallocated Budge a new project called Tanyard Creek @ OCR Drainage. This will provide $100,032 of available funds for the project. Th lowing project will be created by the Finance Department if approved: Tanyard Creek @ OCR Drainage 702- 7121 -62300 $100,032 WORK SESSION [5:07 p.m. — 6:32 p.m.] Stewart Mack, the Lawton Law Firm reviewed and discussed issues related to rates, deregulation and transition to �tition of Entergy Gulf States, Inc., in the provision of electric service. OTHER BUSINESS Thomas Leeper, City Attorney, stated that the meeting scheduled at 6:00 pm to receive comments on rehensive plan is cancelled due to the notice not being pasted 72 hours in advance of the meeting as required by s Open Meetings Act. The City did post a legal advertisement and the meeting has been discussed for the past seve s. The City will allow comments to be made and they will be recorded and heard at a later date for those not able to nt at a future public hearing. A quorum of council will not be present.
