ORD 2011-33 - Amend Ch. 32 - Community Development Mobile Home Requirements 05-17-2011ORDINANCE 2011 -33 AN ORDINANCE AMENDING TITLE 32 COMMUNITY DEVELOPMENT OF THE HUNTSVILLE, TEXAS MUNICIPAL CODE TO PROHIBIT FUTURE PLACEMENT OF MOBILE HOMES CONSTRUCTED BEFORE JUNE 15, 1976, GRANTING LEGAL NON- CONFORMING STATUS TO ALL MOBILE HOMES LEGALLY IN PLACE, ADDING SKIRTING REQUIREMENTS AND UPDATING THE DEFINITIONS OF A MOBILE HOME AND MANUFACTURED HOME. WHEREAS, the City of Huntsville is a home rule city acting under its chatter adopted by the electorate pursuant to the Texas Constitution and Rim Local Government Code; and WHEREAS, the City of Huntsville finds it necessary to regulate the ffittme placement of mobile homes within the city limits and add d irting requirements to add protection to the underside ofmobile and menuSaaturad homes. WHEREAS, the Planning and Zoning Commission of the City of Huntsville at their meeting on Match 24, 2011 held a public hearing prior to consideration of amending the ordinance; WHEREAS, the City Council held a public hearing at their meeting on April 19, 2011 and May 03, 2011 prior to coirsideration of amending the ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVIIXE, COUNTY OF WALKER, STATE OF TEXAS: FINDINGS OF FACT All of the above premises are hereby found to be true and correct legfshdive and factual findings of the City of Huntsville, Texas, and are hereby approved and incorporated into the body of this ordinance as if copied in their entirety. R AMENDMENT Chapter 4, Development Districts, Title 32, Community Development, of the Huntsville, Texas Municipal Code shall be amended as follows: 404. MOBILE AND MANUFACTURED HOMES The installation of mobile homes for use as a dwelling on any property within the City other than as set forth in this section is hereby prohibited; however, a lawfully existing mobile home may be replaced with a HUI}codemamrfactured home. A lawfully existing mobile home may be relocated to a conforming lot or mobilelmanufactured home park provided that all other aspects of this code are met. 404.1 Sldrting Required (1) It shall be unlawful for a person to place a manufactured home within the city unless the mane factmed home is equipped with permanently affixed skating that effectively brides the underside of the manufactured or mobile home from view. The owner and occupant shall have 30 days from the date of initial occupancy to install the required skirting. All skirting shall be constructed of rock, brick, plastic, metal, treated wood, concrete masonry materials or other materials approved by the Building Official, and shall be installed so there is no visible gap between the finished floor of *a manufactured home and the ground Cloth of any type, or shrubbery, is not acceptable material for skirting. Existing manufactured or mobile homes with existing skirting that is in good condition may be allowed until replacement is needed. (2) The skirting used on a particular manufactured or mobile home shall be consistent in material, orientation and color, shall be of such design as to not permit the passage of a sphere four (4) inches or greater in diameter and sball present a continuous and complete surface. .
