ORD 2011-29 - Amend Ch. 44 - Traffic No Parking Signs - South 14th 04-05-2011ORDINANCE NO. 2011-29 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, AMENDING CHAPTER 44, TRAFFIC AND MOTOR VEHICLES, OF ITS CODE OF ORDINANCES BY PLACING NO PARKING SIGNS ON THE SOUTH SIDE OF 14TH STREET BETWEEN AVENUE N AND AVENUE O; AND MAKING OTHER FINDINGS AND PROVISIONS RELATED THERETO; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, THAT: Section 1: The following described no parking anytime zone shall be ratified by the amendments shown below: Street Between South side of 14thStreet Avenue O and approximately 325' east of said intersection The following described no parking between 8 am and 5 pm zone shall be ratified by the amendments shown below: Street Between South side of 14thStreet Avenue N and approximately 223' west of said intersection Section 2: The City Manager is authorized and directed to cause the placement of proper signs along the above described streets. Section 3: It shall be unlawful for driver of a vehicle to disobey the instruction of the signs placed in accordance with the provisions of this ordinance unless at the time otherwise directed by a Police Officer. Section 4: Any person, firm or corporation violating any provision of this ordinance or failing to comply with any requirement of the ordinance will be guilty of a misdemeanor as provided by Article I, Section 44-4 of Chapter 44 of the Huntsville Code of Ordinances being punishable by a fine of not less than $1.00 nor more than two hundred ($200.00) dollars; except that minors who have passed their 14a' birthday but have not reached their 17`" birthday shall be punished by a fine of not more than $100.00. Section 5: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect any of the remaining provisions of this ordinance. Section 6: All ordinances and parts of ordinances in conflict with the provisions of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 7: This ordinance shall take effect ten (10) days after its passage by the City Council. These vehicles parked on the street created sight distance concerns, limited access for emergency vehicles, and prohibited solid waste collection at times for all customers on the street. Upon receiving the request, staff conducted site visits and recommended placing no parking anytime signs along the south side of 14th between Avenues N and O. The signs were placed under the authorization of the City manager. During the 90 day evaluation period, staff received requests to reevaluate a portion of the no parking zone. Based on these comments, the eastern portion of the no parking zone was changed from no parking anytime to no parking 8 -5. Since this final change, staff has received no comments from the neighborhood and the signs as currently Installed have alleviated all concerns. Per a conversation with street Superintendent David Welch, we learned that the zone was established for three reasons: 1. Long Veterinary Clinic, located diagonally across from Hillside Chateau, had filed complaints of parking congestion around their business; 2. Mr. Welch said he spoke with the residents located directly across form Hillside Chateau as well, and they were irritated with the street side parking situation; 3. If parking is allowed street side, emergency vehicles might have trouble navigating this street. Our responses to the above reasons for establishing the zone are as follows: 1. Long Veterinary Clinic does not operate 24 hours a day. If the complaint is in regards to parking issues during business hours, then the zone could be designated for `No Parking Monday Friday 8:00 &m.-5:00 p.m.' Such an adjustment allows Long Veterinary Clinic to be clear of vehicles during the relevant time. Another possibility would be a small `No Parking' zone around the business' driveways. It could start 5 feet from the first curb comer of their driveway and end 5 feet after the second curb of their driveway. This would prohibit parking in front of the business. 2. In regards to the residents directly across from Hillside Chateau, they are no different from most that live in this area. They have vehicles parking in front of the residences as well. We must all share the parking. 3. In regards to the emergency vehicle issue, sections of the street were already designated. `No Parking at Any Time' This combined with the normal driving area of the street should offer more than enough room for safe passage of emergency vehicles. This seems to be supported by the zone not being extended the entire length of 10 Street before and some surrounding streets with similar designated sections. The Hillside Chateau offers 61 designated parking spaces for the residents of its 50 unit community with no designated visitor parking at all and no room for internal expansion. Most if not all residents of the complex have two vehicles. The inability to park in this newly made `No Parking at Any Time' zone poses a problem for Hillside Chateau residents. Since the majority of all other sides of this block are designated as `No Parking at Any Time,' there is little to choose from. Now, the closest external parking for residents or visitors is beyond the intersections of 15a' Street and Avenue M or le Street and Avenue N. Many residents return from or go to work after dark. Having to walk a block or more to or from your car at night is unacceptable. Taking all of this in consideration, we believe that Hillside Chateau residents are being denied a safe and convenient parking area due to the `No Parking at Any Time' assignment. We have spoke of this issue on several occasions.
