Resolution 2014-07 - Reso. 2014-07 - 1012 Thomason Avenue bid - 1/21/2014 RESOLUTION NO. 2014-07 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, ACCEPTING A BID FOR THE SALE FO CITY OWNED PROPERTY LOCATED AT 1012 THOMASON AVENUE AND AUTHORIZE THE CITY MANAGER TO SIGN ALL NECESSARY DOCUMENTS TO COMPLETE THE SALE. WHEREAS the City of Huntsville,Texas (the "City"), is duly incorporated under the general laws of the State of Texas and is operating as a home-rule municipality of the State of Texas,and authorized to sell real property for public purposes;and WHEREAS the City has determined it has the authority to sell the Property pursuant to the City Charter and that all requisites to sell the property have been followed; and WHEREAS the City has determined that the sale of the Property will be a benefit to the citizens of Huntsville; NOW,THEREFORE,be it resolved by the City Council of the City of Huntsville,Texas,that: SECTION 1: That the above findings of fact are adopted by the City Council. SECTION 2: A bid, by Mark Smith, in the amount of $10,551.00 was submitted in accordance with Section 14.13 of the City of Huntsville Charter, as well as Chapter 272 of the Local Government Code. SECTION 3: That the City approves the sale of the Property for the price of$10,551.00 to Mark Smith. SECTION 4: That the City Manager be and hereby is authorized to sign all necessary documents to accomplish the sale of the property subject to final approval of documents by the city Attorney. Strategic Initiative:Strategic Initiative#2 - Huntsville is an economically diverse and developing community. Discussion:The City purchased this property to include in the Neighborhood Stabilization Program (NSP) with the intent to build a home on the lot for low-to-moderate income buyers. The NSP grant contract was for rehab of homes and the new construction of 10 homes. After completion ofbuilding the 10 homes contracted for the program, we were unable to complete this 1 Ith additional home due to cost increases for the building contractov. Thus, staff has determined the best course of action is to dispose of the property. An appraisal was completed on this property on May 17, 2013 which determined a value of$7,5DD. Since the City's intent for this property was to build a house, the city included in the bid that there would be restrictions banning mobile homes and other possible restrictions inthe deed. The deed will "pmohibitrnobi|e/rnanufactured homes for residential use" on the property and the high bidder isaware of this restriction. The bid process culminated with a bid opening on January 6, 3014 at which the City received 8 bids and 1 no bid.The high bid isfor$1[\SS1. Resolution 2014'07 will accept the bid from Mark Smith in the amount of $1O,SS1, and authorize the City Manager tosign all the necessary documents tocomplete the sale. Previous Council Action: There has been noprevious Council action onthis item. Financial Implications: X Item Vmestimated to generate additional revenue: |fapproved,and subject toclosing,the city will receive$10,551. After expenses of$7,94B.64,the net revenue is$2,6O1.49.
