PERROTTA, JR., Deceased ("Applicant") furnishes the following information to the Court in support of this Application for the probate of the written Will of RAY J. PERROTTA JR., a/k/a RAYMOND J. PERROTTA, JR. ("Decedent"), and for issuance of Letters of Dependent Administration with Will Annexed and shows the Court the following: 1. Applicant was appointed as Dependent Administrator of the Estate on December 11, 2012. Subsequent to her appointment, the Administrator located the Decedent's Last Will & Testament in one of two safe deposit boxes. 2. Decedent died on August 20, 2012, in Kingwood, Harris County, Texas, at the age of Seventy-five (75) years having been bom on October 19, 1936. Decedent's domicile at the time of his death was 2906 Silver Falls Drive,Kingwood,Harris County, 77339. 3. This Court has jurisdiction and venue is proper because Decedent was domiciled in Texas and had a fixed place of residence in this County on the date of his death. 4. Decedent owned property described generally as real estate, cash, personal effects and household goods of a probable value in excess of ten thousand dollars($10,000). 5. Decedent left a valid written Will dated August 4, 1980, (the "Will") which was never revoked and is filed herewith. 6. A necessity exists for the administration of the Estate. 7. Decedent was never married. 8. Decedent had no children. 9. Decedent's Will named his friend, Larry R. Baldwin of Missouri City, Fort Bend County, Texas to serve as Independent Executor of his Estate. Mr. Baldwin has executed a Renunciation of his right to serve as Executor. 10. The Decedent named in the alternate, Texas Commerce Bank of Houston, Texas, currently known as JP Morgan Chase Bank, the Successor. JP Morgan Chase Bank, NA has declined to serve as the Executor and has filed a Renunciation of their right to serve as Executor. 11. No state, governmental agency of the state is named as a beneficiary under the Will; however several charities are named and have been served with a copy of this pleading. 11. Decedent's Estate is not a taxable estate and Applicant requests this Court to waive the requirement for appraisals. Perrotta, Jr., residing and being domiciled in Walker County, Texas, United States of America, hereby revoke all previous wills and codicils made by me and hereby make, declare and publish this my Last Will. I. EXECUTOR I hereby nominate and appoint my friend, Larry R. Baldwin of Missouri City, Fort Bend County, Texas as Independent Executor of this Will and of my Estate. If Larry R. Baldwin should fail or cease to serve as Executor, for any reason, then I appoint the Texas Commerce Bank of Houston, Texas as Independent Executor of this Will and of my Estate. My individual Executor and any corporate Executor shall receive such compensation for their services as Executor as is then currently being charged for like services by banks in Harris County, Texas. My individual Executor shall be required to furnish bond but my corporate Executor shall not be required to furnish bond. Whether or not my Estate is indebted to any person, I give unto my Executor from the date of granting of letters until my Estate has been entirely distributed the same rights, powers, authority, privileges and discretion with reference to the control, management and disposition of my Estate that are given to trustees by the provisions of the Texas Trust Act, in addition to all other powers given to Independent Executors by law. I direct that no other action shall be had in any court in relation to the settlement of my Estate than the probating and recording of my Last Will and the return of an inventory appraisement and list of claims of my Estate. Ii. DISPOSITION I give and bequeath to Larry R. Baldwin the sum of TWO THOUSAND AND NO ONE-HUNDREDTHS DOLLARS ($2,000.00) cash. All the rest and residue of my Estate, I give, devise, and bequeath to the following persons or institutions in the following shares: A. A TWENTY-FIVE PERCENT (25%) share to the Texas Presbyterian Foundation, Dallas, Texas, to be used by it solely for awarding college scholarships, career professional development funds, and career guidance counseling aid, to needy and deserving high school graduates from the State of Texas. B. A TWENTY-FIVE PERCENT (25%) share to Columbia University, New York City, New York, to be used by it solely for awarding advanced scientific study research scholarships to needy and deserving college graduates from the State of Texas. C. A TWENTY PERCENT (20%) share to the Houston-Galveston Diocesan Fund to be used by it solely for awarding scholarships to needy and deserving elementary parochial or private school students under the age of twelve years old, from Harris County and adjoining counties in Southeast Texas. D. A TWENTY PERCENT (20%) share to my parents, Elizabeth Angelina Perrotta and Raymond Perrotta, Sr. , both of Houston, Texas. If either of my parents predeceases me, this share shall be given to my surviving parent. If both my parents predecease me, this share shall be given in equal shares to St. Joseph's Hospital, Houston, Texas and Trinity University, San Antonio, Texas. E. A FIVE PERCENT (5%) share to Schreiner College, Kerrville, Texas to be used by it solely for awarding scholarships and fellowships to needy and deserving students and faculty members for advancing their education and professional career development. F. A FIVE PERCENT (5%) share to the City of Huntsville and the Huntsville Independent School District, Huntsville, Texas to be used by it for awarding scholarships and fellowships to needy and deserving students and faculty members for professional, vocational and technical training for further career development; also to promote advanced study and post-graduate research at accredited foreign institutions of higher learning with faculty internationally recognized for excellence and achievement in scholastic endeavors in Science and the Humanities. III. GENERAL PROVISIONS A. If any part of this will shall be invalid, illegal, or inoperative, for any reason, it is my intention that the remaining parts, so far as possible and reasonable, shall be effective and fully operative. My Executor may seek and obtain court instructions for the purpose of carrying out as nearly as may be possible the intention of this Will as shown by the terms hereof;' including the term held invalid, illegal, or inoperative. B. No beneficiary of this Will shall be regarded as surviving me or any other person named or referred to in this will if such beneficiary dies within thirty (30) days of my death or the death of such other person.
