ORD CC 1980-42 - Minimum set-back lines• • ORDINANCE NO. 80- 42 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, ESTABLISHING MINIMUM SET -BACK LINES FOR CONSTRUCTION OR PLACEMENT OF COMMERCIAL AND RESIDENTIAL BUILDINGS OR STRUCTURES; PROVIDING A PENALTY; PROVIDING FOR THE PUBLICA- TION AND EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, THAT: Section 1: The Code of Ordinances of the City of Huntsville, Texas, Chapter 6, "Buildings ", shall be amended by the adoption of a new section 6 -4 that shall read as follows: Section 6 -4. Set back requirements. (a) No building permit shall be issued for the construction, erection or installation of a building or structure, or any part thereof, within twenty -five feet of the property line on the front side of the property. (b) No building permit shall be issued for the construction, erection or installation of a building or structure, or any part thereof, within five feet of any property line. (c) No building permit shall be issued for the construction, erection or installation of a building or structure, or any part thereof, within fifteen feet of any public street or street right -of -way. (d) The provisions of this section shall not apply to: (1) the downtown commercial area (Central Business District) within and bounded by Avenue J, 10th Street, Avenue N, and 15th Street; (2) any structure erected in accordance with the sub- division requirements of a subdivision properly platted after ,'o,,,e 27'x` 1971. Section 2: The Code of Ordinances of the City of Huntsville, Texas, Chapter 11B, "Mobile Homes" shall be amended by the adoption of a new section 11B -17 that shall read as follows: Section 11B -17. Set backs. a. In mobile home parks: (1) all mobile homes shall be located at least ten feet from any property line abutting a public street or highway and at least five feet from interior property lines; • (2) all mobile homes shall be located at least ten feet from any other mobile home and at least five feet from adjoining pavement of a park street, or common parking area, or other common areas. b. Mobile homes parked outside a mobile home park: (1) A mobile home may be parked on a lot or plot outside a mobile home park provided that the vacant area of said lot or plot is greater than 4,000 square feet. (2) The mobile home shall be set back from the front property line no closer than established building lines; no mobile home, however, shall be set within fifteen feet of the front property line or within five feet of any side or back lot line. (3) If a lot or plot is adjacent to two or more streets, the owner may designate any one side adjacent to a street to be the lot front. (4) A mobile home may be parked adjacent to a residence or place of business provided it is set at least ten feet from the nearest building, at least five feet from any property line, and at least fifteen feet from any street or street right -of -way. Section 3: Any person, firm or corporation who shall violate any of the provisions of this Chapter, or who shall fail to comply with same shall be guilty of a misdemeanor, and each such person shall be deemed guilty of a separate offense for each and every day, or portion thereof, during which any violation of any of the provisions of this chapter is committed, continued, or permitted, and upon conviction thereof shall be punished by a fine of not exceeding two hundred dollars ($200.00). Section 4: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such re- peal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regula- ting and governing the subject matter covered by this ordinance. Section 5: If any provision or part of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their applica- tion to other persons or sets of circumstances and to the end all pro- visions of this ordinance are declared to be severable. • • • Section 6: This ordinance shall take effect immediately upon its publication.
