AN ORDINANCE AMENDING SECTION 17 -11, ARTICLE I, CHAPTER
17 OF THE CODE OF ORDINANCES OF THE CITY OF HUNTSVILLE,
TEXAS BY INCREASING THE CUTTING OFF AND TURNING ON
CHARGE FROM $ 5.00 TO $ 10.00, AND BY ADDING A NEW SECTION
17 -15, ARTICLE I OF THE CODE OF ORDINANCES OF THE CITY
OF HUNTSVILLE, TEXAS, BY PROVIDING FOR A NEW PARAGRAPH
SECTION 17 -15 ENTITLED CHARGE FOR RETURNED CHECKS, PROVIDING
THAT A $ 5.00 CHARGE WILL BE MADE TO THE WATER CUSTOMER
WHO ATTEMPTS TO MAKE PAYMENT FOR WATER SERVICE BY PASSING
A CHECK WHICH IS RETURNED BECAUSE OF INSUFFICIENT FUNDS
IN THE CUSTOMER'S BANK ACCOUNT.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE,
TEXAS, that Section 17 -11, Article I, Chapter 17 of the Code of
Ordinances of the City of Huntsville, Texas, is hereby amended as
follows:
Section 17 -11. SAME- Failure to pay.
Failure or refusal to pay any water bill by any customer
of the City upon demand, from and after the 10th of any month,
shall constitute a breach of contract and the City shall, within
ten days from notice of such failure, cut off such service from the
customer and shall not renew the same until the customer has
paid all delinquent bills plus $ 10.00 as a cutting off and turning
on charge.
BE IT FURTHER ORDAINED BY THE CITY COUNCIL OF THE CITY OF
HUNTSVILLE, TEXAS, that the Code of Ordinances of the City of
Huntsville, Texas, be amended by adding a new paragraph, Section
17 -15, Article I,,Chapter 17 of the Code of Ordinances of the City
of Huntsville, Texas, as follows:
Section 17 -15. Charge for returned checks.
The manager of utilities, or any other appropriate City
employee shall charge any water customer of the City of Huntsville
a $ 5.00 charge for checks returned by the customer's bank advising
the City thegeare not sufficient funds in the customer's checking
account with the bank to pay the water charge for the customer. This
$ 5.00 charge shall be added to the total outstanding account of the
customer and upon refusal or failure to pay this charge, Section 17 -11
hereof shall apply as to said charge.
BE IT FURTHER ORDAINED BY THE CITY COUNCIL OF THE CITY OF
HUNTSVILLE, TEXAS, that this ordinance shall be effective from and
after its passage.
