ORD CC 01/13/76 - Amending Ch. 9 and 11 - Health-GarbageORDINANCE NO. 76 -1 AN ORDINANCE AMENDING CHAPTER 9, ENTITLED GARBAGE D REFUSE AND CHAPTER 11, ENTITLED HEALTH AND SANITATION OF THE CODE OF ORDINANCES OF THE CITY OF HUNTSVILLI, TEXAS, BY ADDING DEFINITIONS TO CHAPTER 9, SECTION 9 -1, AND BY AMENDING SECTION 9 -7 to CONFORM WITH OTHER AMENDMENTS TO THE HEALTH AND SANITATION CODE OF THE CITY OF HUNTSVILLE, BY AMENDING SAID HEALTH AND SANITATION CODE BY ADDING A NEW SECTION TO BE KNOWN AS SECTIO 11 -26, PROVIDING FOR RECLAMATION PERMITS TO BE ISSUED TO LOW ACCUMULATION OF CERTAIN MATERIALS FOR RECLAMATION •F REAL PROPERTY, BY AMENDING SECTION 11 -25, TO ELIMI ATE CONFLICTS WITH THE NEW SECTION 11 -26, AND PROVIDIN AN EFFECTIVE DATE. WHEREAS, in the interest of the Public Health and certain Ordinances of the City of Huntsville, Texas, now p the dumping or accumulation of specified waste or unusable materials or substances, which Ordinances are in the best of the public Health and Welfare; however, the City Counci City of Huntsville, finds that certain parcels of real pro within the said City can be reclaimed for proper use by pr of fill materials in such areas, provided that materials u fill would not be detrimental or injurious to the public h that therefore in order to utilize to the maximum extent p all real property and at the same time protect the interes public health from dumping or discarding of improper waste provision should be made for reclamation of real property approval of the City Health Officer and that the public in would be best served by the passage of an ordinance author same. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL CITY OF HUNTSVILLE, TEXAS, that Section 9 -1, Chapter 9, of of Ordinances of the City of Huntsville be amended in the particulars: SECTION 1: Section 9 -1 entitled definitions of th Ordinances of the City of Huntsville is hereby amended to following additional definitions: Sec. 9 -1. Rubbish or Trash: The words "rubbish" or "trash" s all be interpreted to mean a mixture of putrescible and non-putrescible wastes. The definitions herein shall apply throughout the •ode of Ordinances of the City of Huntsville unless otherwise spec'fied. SECTION 2: Section 9-7 of Chapter 9 of the Code of Ordinances is hereby amended by adding to the existing paragraph the following proviso: Sec. 9-7. Disposal at other than dumping grounds ar incinerator prohibited.
