AN ORDINANCE AMENDING CHAPTER 11 OF THE CODE OF ORDINANCES OF
THE CITY OF HUNTSVILLE, TEXAS, BY ADDING A NEW SECTION ENTITLED: SECTION
11 -39, THAT NO PERSON, FIRM OR CORPORATION SHALL DE-
POSIT TRASH, GARBAGE, OR OTHER REFUSE IN ANY SANITA-
TION CONTAINER PROVIDED BY THE CITY OF HUNTSVILLE FOR
USE BY OTHER PERSONS, FIRMS OR CORPORATIONS AND TO WHOM
CHARGES ARE MADE FOR SUCH USE, PROVIDING A PENALTY, AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Huntsville Sanitation Department
after careful survey of the requirements for trash, garbage or
refuse disposal for various persons and businesses has located at
various points within the City of Huntsville sanitation con_
tainers for use by persons, firms and businesses with the size of
each respective container determined by the survey conducted in
meeting the requirements of trash disposal and for which such persons
are charged a monthly fee by the City of Huntsville based upon the
volume of trash disposal which system is in the best interest of the
City of Huntsville and its citizens in disposing of garbage, trash
and refuse, preventing accumulations thereof, and thereby preventing
disease and unsightliness in the interest of the public health and
welfare, and
WHEREAS, it has now been brought to the attention of the
City of Huntsville that various persons are depositing trash, garbage
and refuse into sanitation containers placed and intended for use by
other persons, firms or corporations paying the monthly charges for
such container, resulting in overloading of said containers, spillage
of trash, refuse and garbage, and otherwise creating an unsanitary
and unhealthy condition by virtue of such unauthorized useage causing
an overloading of containers and in order to prevent such unauthorized
use and in furtherance of the public health and welfare a necessity
exists to prohibit the unauthorized use of such sanitation containers
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF HUNTSVILLE, TEXAS, that Chapter 11 , Section 11 -39 , of
the Code of Ordinances of the City of Huntsville, Texas, is hereby
created to read as follows:
SECTION 11 -39 Unauthorized use of sanitation containers prohibited
A. It shall hereafter be unlawful for any person, firm
or corporation to deposit garbage, trash or other refuse
of any type in any sanitation container provided by
the Sanitation Department of the City of Huntsville,
Texas, for use by other persons, firms or corporations
and to whom a monthly charge is made for such service.
Any person violating the provisions of this ordinance
shall, upon conviction, be deemed guilty of a class C
misdemeanor and punished as provided in Section 1 -8
of the Code of Ordinances of the City of Huntsville,
Texas.
BE IT FURTHER ORDAINED BY THE SAID CITY COUNCIL OF THE
CITY OF HUNTSVILLE, TEXAS, that the within ordinance shall become
effective as provided by the Code of Ordinances of the City of
Huntsville, Texas.
