ORDINANCE AMENDING CHAPTER 17, SECTION 17 -8 OF
THE CODE OF ORDINANCES OF THE CITY OF HUNTSVILLE,
TEXAS, BY ADDING A SUB- PARAGRAPH PROVIDING THAT
UPON THE TRIAL OF ANY CAUSE IN WHICH THE VIOLATION
OF SAID ORDINANCE IS SOUGHT TO BE PROVED, PRIMA
FACIA PROOF SHALL BE ESTABLISHED UPON PROOF OF THE
PERSON IN WHOSE NAME SAID WATER METER IS LISTED IN
OFFICIAL CITY RECORDS OR THE OCCUPANT OF THE PREMISES
SERVED BY SAID WATER METER, AND PROVIDING FOR AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE,
TEXAS, that Chapter 17, Section 17 -8, of the Code of Ordinances of
the City of Huntsville, Texas, is hereby amended by adding a sub-
paragraph to be numbered sub - paragraph (d) to read as follows:
SECTION 17 -8: In control of and interference with meters, valves,
etc.
(d) Upon the trial of any cause for which a violation
of this ordinance is charged, proof that the person
charged is the person in whose name said water meter
is listed in official City records or the occupant
of the premises obtaining water through such meter,
shall be prima facia proof of the violation of said
ordinance by the person so charged.
BE IT FURTHER ORDAINED THAT the within ordinance shall be
effective from and after the date hereof.
