AN ORDINANCE AMENDING CHAPTER 17, SECTION 17 -8 OF THE
CODE OF ORDINANCES OF THE CITY OF HUNTSVILLE, TEXAS, BY ADDING
ADDITIONAL PARAGRAPHS TO PROVIDE THAT NO PERSON, FIRM OR CORPORATION
SHALL TAKE, USE, OR OTHERWISE ALLOW WATER TO FLOW FROM ANY FIRE PLUG
WITHIN THE CORPORATE LIMITS OF THE CITY OF HUNTSVILLE WITHOUT FIRST
OBTAINING A PERMIT THEREFOR, PROVIDING FOR PAYMENT OF WATER, PRO-
VIDING A PENALTY FOR VIOLATION OF SUCH ORDINANCE, EXCLUDING EMERGENCY
USE AND FURTHER PROVIDING THAT NO FIRE PLUG VALVE SHALL BE OPENED
UNLESS AN OFFICIAL WRENCH IS USED, AND PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE,
TEXAS, THAT CHAPTER 17, SECTION 17 -8 OF THE CODE OF ORDINANCES OF
THE CITY OF HUNTSVILLE, TEXAS, BE AMENDED AS FOLLOWS:
Section 1: The present Section 17 -8 of Chapter 17 of the Code of
Ordinances as set forth in the Code of Ordinances of
the City of Huntsville, Texas, is hereby redesignated
to be sub - paragraph (a) of Section 17 -8.
Section 2: Section 17 -8 of the Code of Ordinances of the City of
Huntsville, Texas, is hereby amended by adding additional
sub - paragraphs to be numbered sub - paragraphs (b), (c) and
(d) and to read as follows:
Section 17 -8 (b): It shall hereafter be unlawful for any
person, firm or corporation, to take,
use, turn on, or otherwise allow water
to flow from any fire plug located in
in the City of Huntsville water supply
system without first obtaining a permit
therefor. Such permit shall be obtained
from the designated office of the City
Water Department and shall authorize
the permitee to obtain water through a
fire plug as may be necessary and under
such conditions as may be established
from time to time by the City Water
Department. Payment for such water shall
be on the basis and charges as determined
from time to time by the City Water De
partment, as approved by the City Council
and a deposit for the estimated charge
shall be made with the City Water De-
partment prior to the issuance of any
such permit. Such permit shall be valid
for such time as determined by the City
Water Department commensurate with the
estimated useage and upon expiration of
such permit, any water used in excess of
the deposit made shall be paid upon re-

turn of such permit with certification
as to water used. Any refund due the
permitee for excess deposit shall be
made by the City as soon as practicable.
Failure to obtain such permit prior to
obtaining water from any fire plug within
the City water system shall be a Class
C misdemeanor and punishable as provided
in Section 1 -8 of the Code of Ordinances
of the City of Huntsville, Texas.
Be it further ordained that it shall
likewise be unlawful for any person,
firm or corporation toopen any valve,
cock, or turn on lever on any fire plug
within the City water supply system unless
an official fire plug wrench is used for
such purpose. Violation of this provision
shall be a Class C misdemeanor and punish-
able as provided by Section 1 -8 of the
Code of Ordinances of the City of Hunts-
ville, Texas.
Be it further ordained that emergency
use of water from fire plugs located in
the City of Huntsville water supply
system is specifically excluded from
the provisions hereof.
