ORD CC 06/26/73 - Service ChargesAN ORDINANCE AMENDING CHAPTER SEVENTEEN, ARTICLE II, WATER AND SEWER ORDINANCE OF THE CITY OF HUNTSVILLE, TEXAS, BY ADD- ING FOUR NEW SECTIONS, 17.25, SERVICE CHARGE - BILLING, WHEN PAYABLE; SECTION 17.26, SERVICE CHARGE - PENALTY FOR NON - PAYMENT; SECTION 17.39, PENALTY FOR VIOLATING ORDINANCE; SECTION 17.40, SAVINGS CLAUSE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, THAT CHAPTER SEVENTEEN,ARTICLE II, OF THE CODE OF ORDINANCES OF THE CITY OF HUNTSVILLE, BE AMENDED BY ADDING FOUR NEW SECTIONS TO BE NUMBERED 17.25, 17.26, 17.39 and 17.40 WHICH SAID NEW SECTIONS SHALL READ AS FOLLOWS: SECTION 17.25. SERVICE CHARGE - BILLING, WHEN PAYABLE All bills for sewer service charge shall be accomplish- ed by including same on the monthly water bill rendered by the City and shall be payable within 15 days from date of billing. Failure to receive such bill shall not relieve the customer from penalty as provided in Section 17.26. SECTION 17.26. SERVICE CHARGE - PENALTY FOR NON - PAYMENT If any persons fails to pay the current or delinquent service charges as shown on his monthly bill within fifteen (15) days from the date of such bill, there shall be added to such charge a penalty of 10% of such unpaid charge. SECTION 17.39. PENALTY FOR VIOLATION Any person, firm or corporation who shall violate any of the provisions of this Ordinance, or who shall fail to comply with same shall be guilty of a misdemeanor and upon conviction thereof shall be punished by fine not exceeding $200.00. Each and every day or fraction thereof which this ordinance or any part thereof shall be violated, shall be deemed a separate offense. SECTION 17.40. SAVINGS CLAUSE That if any Section, part or provision of this ord- inance is declared unconstitutional or invalid, then, in that event, it is expressly provided, and it is the intention of the City Council in passing this ordinance, that all other parts of this ordinance shall not be affected thereby, and shall remain in full force and effect.
