ORD CC 06/26/73 - Water billingAN ORDINANCE AMENDING CHAPTER SEVENTEEN, ARTICLE I, WATER AND SEWER ORDINANCE OF THE CITY OF HUNTSVILLE, TEXAS, BY ADDING TWO NEW SECTIONS 17.15- PENALTIES AND 17.16 - SAVINGS CALUSE; and BY AMENDING SECTION 17,10- MONTHLY CHARGES FOR WATER - BILLING, WHEN PAYABLE; AND SECTION 17.11 - MONTHLY CHARGE FOR WATER - PENALTY FOR NON - PAYMENT. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE, CITY OF HUNTSVILLE, TEXAS, THAT CHAPTER 17, ARTICLE I OF THE CODE OF ORDINANCES OF THE CITY OF HUNTSVILLE, BE AMENDED BY ADDING TWO NEW SECTIONS TO BE NUMBERED 17.15 AND 17.16, AND BY AMENDING SECTIONS 17.10 AND 17.11, SO THAT SAID SECTIONS SHALL READ AS FOLLOWS: SECTION 17.10. MONTHLY CHARGES FOR WATER - BILLING, WHEN PAYABLE All bills for water furnished by the city shall be rendered monthly and shall be payable within fifteen (15) days from date of billing. Failure to receive such bill shall not relieve the customer from forfeiture or penalty as pro- vided in Section 17.11. SECTION 17.11. MONTHLY CHARGES FOR WATER - PENALTY FOR NON- PAYMENT A. If any customer fails to pay his current or delinquent charges as shown on his monthly bill within 15 days from the date of such bill, there shall be added to such charge a penalty of 10% of such unpaid charge. B. If any customer fails to pay his delinquent charges and penalty as shown on his monthly water bill within fifteen (15) days from the date of such bill, the city shall cut off such service from the customer and shall not renew the same until the customer has paid such delinquent charges and penalty, plus a reconnection charge. SECTION 17.15 PENALTIES Any person, firm or corporation who shall violate any of the provisions of this ordinance, or who shall fail to comply with same shall be guilty of a misdemeanor and upon con- viction thereof shall be punished by fine not exceeding $200.00. Each and every day or fraction thereof which this ordinance or any part thereof shall be violated, shall be deemed a separate offense. SECTION 17.16. SAVINGS That if any Section, part or provision of this ordinance is declared unconstitutional or invalid, then, in that event, it is expressly provided, and it is the intention • of the City Council in passing this ordinance, that all other parts of this ordinance shall not be affected thereby, and shall remain in full force and effect. 1973.
