AN ORDINANCE AMENDING AN ORDINANCE DATED JANUARY 23, 1973, CLOSING
THE HEARING GIVEN TO REAL AND TRUE OWNERS OF PROPERTY ABUTTING UPON
STREETS IN THE CITY OF HUNTSVILLE, TEXAS, AND LEVYING AN ASSESSMENT
FOR THE PAYMENT OF A PORTION OF THE COST OF IMPROVING SUCH STREET
BY AMENDING SECTION 4(d) OF SAID ORDINANCE INCREASING THE PER FOOT
ASSESSMENT AGAINST THE PROPERTIES AND THE TRUE AND LAWFUL OWNERS OF
SUCH PROPERTY AS STATED THEREIN.
WHEREAS, by ordinance date January 23, 1973, the City
Council of the City of Huntsville, Texas, authorized certain improvements
to be made to certain streets within said City including the paving of
Stern Road from its intersection with feeder road of Interstate 45
to the West boundary of Boettcher Drive with such authorization to con-
sist of paving only and no curb and gutter; and
WHEREAS, subsequent to the passage of said ordinance, at
the request of interested property owners, the said City Council by
change order to the contract originally let for construction of such
improvements, curb and gutter of Stern Road was added thereby increasing
the estimated cost of improvements to the amount of $56,611.95, and by
virtue thereof necessitated the increase of assessment against said
properties and the true and lawful owners thereof from the assessment
for non curb and gutter streets to the assessment attributable to curb
and gutter streets.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF HUNTSVILLE, TEXAS, THAT AN ORDINANCE HERETOFORE PASSED ON
JANUARY 23, 1973, CLOSING THE HEARING GIVEN TO REAL AND TRUE OWNERS OF
PROPERTY ABUTTING UPON STREETS IN THE CITY OF HUNTSVILLE, TEXAS, CON-
CERNING THE LEVYING OF ASSESSMENTS FOR THE PAYMENT OF A PORTION OF COSTS
OF IMPROVING SUCH STREETS, AND IN PARTICULAR, SECTION 4 (d) OF SAID
ORDINANCE BE AMENDED TO READ AS FOLLOWS:
Section 4 (d): To pave Stern Road from its intersection with feeder
road of Interstate 45 to the West boundary of Boettcher
Drive, with 1,742 feet of paving on the West side of said
street, and 1,717 feet of paving on the East side of said
street, with ourb and gutter on both sides, which said
street is located in the City of Huntsville, Walker County,
Texas, in the E. Davids Survey, Abstract No. 157.

BE IT FURTHER ORDAINED BY THE CITY COUNCIL OF THE CITY
OF HUNTSVILLE, TEXAS, THAT SAID CITY COUNCIL IN ADHERING TO THE RE-
QUEST OF INTERESTED PARTIES TO AMEND SAID PREVIOUS ORDINANCE AND TO
CURB AND GUTTER STERN ROAD, THAT SAID CITY COUNCIL FOUND THAT SAID
PROPERTY WOULD BE SPECIALLY BENEFITTED AND ENCHANCED IN VALUE IN
EXCESS OF THE AMOUNT OF COST OF SAID IMPROVEMENTS PROPOSED TO BE MADE
AND ASSESSED AGAINST SAID PROPERTIES AND THAT THE FRONT FOOT PLAN OF
ASSESSMENT AT THE RATE OF $5.50 PER FRONT FOOT WAS IN 'crier
