BIDS FOR EXPENDITURES IN EXCESS OF $1,000.00, ALI-
DATING PREVIOUS PURCHASES, DECLARING AN EMERGENCY
AND ESTABLISHING AN EFFECTIVE DATE:
Section 1: BE IT ORDAINED BY THE CITY COUNCIL OF THE CI OF
HUNTSVILLE, TEXAS, THAT THE CODE OF ORDINANC S OF
THE CITY OF HUNTSVILLE, TEXAS, BE AMENDED TO PRO-
VIDE A SECTION ON PURCHASING PROCEDURE WHICH SAID
SECTION SHALL READ AS FOLLOWS:
PURCHASING PROCEDURES
A. All purchases and contracts of the City f Huntsville
calling for the expenditure of City fund- in excess
of $1,000.00 shall be submitted to compe itive bidding
prior to the execution of any contracts •r purchase
of supplies or equipment. All such cont acts shall
be let to the lowest responsible bidder •nd the City
shall have the right to reject any and all bids.
Notice of the time and place when and where such
contracts shall be let shall be as direc ed by the
City Council of the City of Huntsville b publication
in the official newspaper of the City o -e a week for
two consecutive weeks with the date of first publi-
cation to be at least fourteen days pri r to the date
set for letting said contract or by dir ct notification
by mail to prospective bidders soliciti g bids for
the intended purchase or the proposed c ntract with
such letters to be mailed to prospectiv bidders at
least fourteen days prior to the date s t for the
letting of said contract. The City Cou cil shall
designate at the time request for bids 's authorized
the manner in which such notice shall b given.
B. Competitive bidding for expenditures or contracts
in excess of $1,000.00 shall not be req ired for
contracts for personal or professional ervices or
otherwise where specific exemptions for the require-
ment of notice are contained in the cha ter of the
City of Huntsville, Texas, or by statut
C. Proposed expenditures and contract call ng for the
expenditure of funds in excess of $1,00 .00 shall
be first presented to the City Council t regular
or special session by the City Manager r City
Secretary, as the case may be, at which time the
Council shall authorize the manner of g ving of
notice and request for competitive bid. Such notice
or request for bids shall be signed by he City
Manager or the City Secretary, as the c se may be,
and shall be returnable to the office o the City
Manager on or before the bid letting da e and any
such plans and specifications in connec ion with
the proposed expenditure shall be on fi e in the
office of the City Manager for examinat'on by any
prospective bidder.
Section 2: BE IT FURTHER ORDAINED BY THE CITY COUNCIL fJF THE CITY
OF HUNTSVILLE, TEXAS, THAT ALL PRIOR EXPEND TURES, CON-
TRACTS, PURCHASES, AND OTHER MATTERS INVOLVING COMPETITIVE
BIDS IN WHICH NOTICE OF REQUEST FOR BIDS WAS GIVEN BY
EITHER METHOD SPECIFIED IN SECTION 1 ABOVE RE IN ALL
THINGS VALIDATED, RATIFIED, CONFIRMED AND PPROVED.

Section 3: BE IT FURTHER ORDAINED BY THE CITY COUNCIL 0 THE
CITY OF HUNTSVILLE, TEXAS, THAT SECTION 11.1 OF
THE CHARTER OF THE CITY OF HUNTSVILLE, TEXAS, PRO-
VIDES FOR THE EXPENDITURE OF FUNDS IN EXCESS OF
$1,000.00 TO BE DONE BY COMPETITIVE BIDDING AS PRO-
VIDED BY LAW OR ORDINANCE AND THAT PURSUANT 0 SAID
CHARTER PROVISION NO ORDINANCE HAS HERETOFOR BEEN
PASSED AND THAT BY VIRTUE THEREOF AN EMERGEN Y EXISTS
REQUIRING THE PASSAGE OF THE WITHIN ORDINANC AND THE
IMMEDIATE IMPLEMENTATION OF THE BIDDING PROC DURE AS
AUTHORIZED HEREIN AND THAT BY VIRTUE THEREOF, THE WITHIN
ORDINANCE SHALL BE VALID AND EFFECTIVE FROM ND AFTER
ITS APPROVAL BY THE CITY COUNCIL OF THE CITY OF HUNTS -
VILLE, TEXAS.
