AN ORDINANCE AMENDING CHAPTER THREE A OF THE CODE OF ORDINANCES
OF THE CITY OF HUNTSVILT,E, TEXAS, BY ADDING A NEW SECTION TO BE
NUMBERED SECTION THREE A -2 PROHIBITING THE SATE OF
ALCOHOLIC BEVERAGES. WITHIN A SPECIFIED DISTANCE OF ANY CHURCH,
PUBLIC SCHOOL, OR PUBLIC HOSPITAL, PROVIDING A PENALTY THEREFOR,
AND PROVIDING A REMEDY FOR ENFORCEMENT THEREOF:
BE IT ORDAINED by the City Council of the City of Huntsville,
Texas, that Chapter of the Code of Ordinances, of the City
of Huntsville, Texas, is hereby amended by adding a new section, to
be numbered Section Three A -2 which said Section Three A -2
shall read as follows:
Section 3 A -2 Sale of Alcoholic Beverages, prohibited
in specified places.
A. No person, dealer, corporation, partnership, or other
business entity shall sell or offer to sell any alcoholic beverage
at a location within the corporate limits of the City of Huntsville,
Texas, when such location is within 300 feet of any church, public
school or public hospital,the measurements to be along the property
lines of the street fronts and from front door to front door and in
direct lines across intersections where they occur.
B. Any person, dealer, corporation, partnership, or other
business entity violating the provision of this Section shall,
upon conviction, be deemed guilty of a misdemeanor and shall be
punished as provided in Section 1 -8 of the Code of Ordinances of
the City of Huntsville.
C. The City of Huntsville may further enforce the provisions
of this Section by any action, at law or in equity, to enjoin any
person, dealer, corporation, partnership, or other business entity
from conducting any business in violation of this Section.
PASSED IN OPEN SESSION by unanimous vote on this the 14th
day of December, A.D., 1971.
