ORD CC 11/23/71 - Street ImprovementsJ AN ORDINANCE DESIGNATING CERTAIN IMPROVEMENTS TO BE MADE UPON CERTAIN STREETS WITHIN THE CITY OF HUNTSVILLE, TEXAS, SETTING FORTH THE TYPE OF IMPROVEMENTS TO BE MADE, STATING THE ESTIMATED COST OF IMPROVEMENTS AND GIVING NOTICE TO INTERESTED PROPERTY OWNERS OF THE DATE AND TIME SET FOR A HEARING'ON SAID PROPERTY IMPROVEMENTS: BE IT ORDAINED by the City Council of the City of Hunts- ville, Texas: WHEREAS, the City of Huntsville, Texas, acting under and by virtue of Title 28, Chapter 9, Revised Civil Statutes of the State of Texas of 1925, and all amendments thereof, par- ticularly Article 1105B thereof, andby Ordinance approved Novem- ber 23, 1971, has determined that a necessity exists for making certain improvements in cooperation with the State of Texas to certain specified streets within the corporate limits of the City of Huntsville, Walker County, Texas, which said improvements are of the nature and located on certain streets as follows: A. To widen, pave, and install curb and gutter on Sam Houston Avenue from a point at its intersection with llth Street South to a point South of its intersection with Sycamore Street with 4346.1 feet of curb and gutter on the East side of said street and 5192.5 feet of curb and gutter on the West side of said street for a total distance of 9538.6 feet with the said City of Huntsville, to incur the costs of curb and gutter only. TOTAL ESTIMATED COSTS OF CURB AND GUTTER IMPROVEMENTS $ 22,892.64 The pavement and improvement of such street and the installation of said curb and gutters shall be done in accor- dance with plans and specifications prepared by the Texas High- way Department and the City Engineer of the City of Huntsville, Texas, and approved by the Council. The paving and improve- ments shall consist of raising, lowering and grading of said street, constructing storm drainage, and where applicable con- crete curbs and gutters and paving the same with appropriate covering as specified in said plans and specifications including base course and surface topping. The width of the pavement of said street containing curb and gutters to be 48 feet, beginning at llth Street to 22nd Street, and 60 feet from 22nd Street to Sy- camore Street. The amounts to be assessed against abutting pro- perty owners shall not exceed the amount allowed by law and such assessments shall be paid by abutting property owners on the front foot plan as the most equitable method of assessment. Be it further ordained that the estimate of the costs of such improvements to the extent of the cost incurred by . the said city of Huntsville, Texas, in accordance with its agree- ment with the Texas Highway Department of the State of Texas, as prepared by the City Engineer of the City of Huntsville, Texas and now on file with the Secretary of the City of Huntsville, Texas, heretofore prepared by the said City Engineer under, the direction of the City Council be, and the same is hereby approved. It is further ordained that a statement of the esti- mated amount of the assessment to be made against the Owner or owners or Claimants of abutting property and against said pro- perty will be filed in the office of the City Secretary, and the interested parties shall have the rightto examine the same at all reasonable hours. That the estimated amount or amounts per front foot proposed to be assessed the Owner or Owners or Claimants of abutting property and against said property for the purpose of installing curbs and gutters shall not be in excess of $2.40 per front foot and that said sum include curb cuts and driveways for the length of said curb and gutter estimate. it further ordained that a hearing shall be heard by and before the City Council in the City all of the City of Hunts- ville, Texas, on the ,4-0.), day of , 1971, at ri'p 0 o1clock-r.M., as provided by law, at which time and place all persons interested in the paving and improvements, including the owner and or owners of property abutting said streets or interested therein, and all persons owning, claiming and interested in said project may appear and be heard with reference to all needs per- taining to the paving and improvements of said street, which hear- ing shall be continued from day to day until finally accomplished. No assessment shall be made against any abutting property or owner thereof in excess of the special benefits to such property, and its owners, in the enhanced value thereof by means of suchlimprove- ments as determined at such hearing. The City Secretary is hereby directed to give notice of said hearing by publishing a true copy of this ordinance in the Huntsville Item, three (3) times, the first publishing to be at least 21 days before the day of hearing; and, additional written notice of the hearing shall be given by depositing in the United States mail at least 14 days before the date of the hearing written notice of such hearing, postage prepaid in an envelope addressed to the owners of the respective properties, abutting such streets, as the names of such owners are shown on the then current rendered tax rolls of such city and at the addresses as shown, or if the names of such respective owners do not appear on such rendered tax rolls, then addresses to such owners as their names are shown on the current unrendered rolls of the City at the addresses shown thereon. On motion duly made and executed, the above and foregoing ordinance was read before a regular meeting, of the City Council, voted upon and passed by unanimous vote of the Council and was duly adopted this 23rd day of November, 1971.
