ORD 01/15/64 - Morgas Company warranty deedAN ORDINANCE AUTHORIZING ANDEIRECTING THE MAYOR OF THE CITY OF HUNTSVILLE, TEXAS, TO CONVEY BY WARRANTY DEED 10 ACRES OF LAND, MORE OR LESS, IN THE WARREN BIRDSELL SURVEY, ABSTRACT NO. 6, IN WALKER COUNTY, TEXAS, TO MORGAS COMPANY FOR THE CONSIDERATION OF TEN THOUSAND AND N0 /100 DOLLARS, CASH, SETTING OUT THE RESERVATIONS AND RESTRICTIONS PERTAINING THERETO. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS: THAT the City of Huntsville, Texas, sell and cause to be conveyed to Morgas Company, a Texas Corporation, 10 acres of land, more or less, situated in the WARREN BIRDSELL SURVEY, Abstract No. 6, in Walker County, Texas, a part of a 630 acre tract described in a deed from the Texas Prison Board to the City of Huntsville, Texas, dated November 19, 1945, and recorded in Volume 112, Page 55, of the Deed Records of Walker County, Texas, subject to the royalty reservations contained inasaid deed, which said 10 acres of land shall be described by metes and bounds as follows: BEGINNING at the intersection of the west line of said 630 acre tract with the northeast right -of -way line of Interstate Highway No. 45, a stake for corner; THENCE N 0. 30' E 520.94 ft, stake for corner on the west line of said 630 acre tract; THENCE N 89. )0 E 580.47 ft, stake for corner; THENCE S 0. 30' W 979.92 ft, to the northeast right -of -way line of Interstate Highway No. 45, stake for corner; THENCE N 52' 10' W with the northeast right -of -way line of said Interstate Highway No. 45, 740 ft to'thel place of beginning, containing 10 acres of land, more or less; Said conveyance, however, shall be made subject to, and skid premises shall be encumbered with the following covenant which shall run with the land: Said premises shall be used and occupied for industrial and commercial purposes only, except incidental residential housing of employees and personnel connected with the operation of such commercial and industrial purposes; providing, if the grantees, its successors or assigns, shall violate or attempt to violate this covenant, it shall be lawful for the grantor or any person or persons who have or may hereafter purchase property from the grantor, its successors or assigns, out of said 630 acres tract, to prosecute any proceeding at law or in equity against the grantee or persons violating such covenant and to obtain an injunction prohibiting such violation and to recover damages or other dues for such violation. Said deed shall also except the royalty reservations contained in the deed from Texas Pris *r Board to the City of Huntsville, Texas. The consideration to be paid for said land is TEN THOUSAND AND N0 /100 ($10,000.00) DOLLARS, cash, and the Mayor is hereby authorized to execute the deed on behalf of the City of Huntsville, Texas, and the City Secretary attest the same, to be delivered to the purchaser upon receipt of said consideration by the City of Huntsville, Texas, which appropriate revenue stamps attached and to furnish and Owner's Title Insurance Policy to the purchaser. DONE at a meeting of the City Council at the City Hall in the City of Iiuntaville, Texas, on the 15th day of January, 1964. APPROVED this 15th day of January, 1964. ATTEST ETARY RAYMOND T. iRIGNT.
