AN ORDINANCE CREATING THE CITY OF HUNTSVTT.Tr, PLANNING AND ZCHING COMMISSION, PRESCRIBING THE POWERS AND DUTIES OF ITS MEEBERS . AND THEIR TERM OF OFFICE, REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH AND PROVIDING A SAVINGS CLAUSE. BE IT ORDAINED BY THE CITY COUNCIL OF HUNTSVILLE, TEXAS: Section I. There is hereby created and established within the City of Huntsville, Texas, a Planning and Zoning Commission, hereinafter referred to ae "The Cobsdwion^, which Shall be subject to the jurisdiction of the City Council, such plannij g and zoning commission to be composed of nine (9) members Whose offices are hereby creathd and established. The members of the commission shall be resident cltiaena of the Corporate Limita of the City of Huntsville, Texas, owners of real estate in the City of Huntsville, tax payers and qualified voters of the City of Huntsville. The members of the commission shall be appointed by the Mayor with the advise and approval of the City Council. The term of office of said members shall be six (6) years; provided, however, at the first meeting of the first nine (9) members of the commission, Such members shall draw by lot to determine which three (3) members shall serve two (2) years, which three (3) members shall Serve four (4) years, and which three (3) members shall serve six (6) yearn; there- after three (3) members shall be appointed each two (2) years for a full Six (6) year term. In making such appointments, one appointee shall be named as Chelan= and one as Vice -Chairman. After the appointment of the original members thereat all vaoanciee occurring on the commission shall be filled by appointment ofths Mayor with the advice and approval of the Council. Oho Berbers of the commission in the performance of their duties shall receive the sum of ONE DOLLAR =1.00) per year. — Section II. The commission shall recommend to the City Council the appointment of such individuals as Bay, in the opinion of the Commission, be necessary for the proper conduct, operation and undertaking of the Commission, including from time to time an engineer or City Planning Consultants of recofsised standing. in the field of city plsnriing and zoning; such engineer or city planning consultant/' shall perform the duties prescribed by the Commission and be approved by the City Council and shall receive such compensation as may be affixed by the City Council. 4* • Section III. All Department Heads and Officials of the City of Huntsville shall be available to the Commission for advice and consultation and they shall co. operate with and render such services for the Commission as shall come within the scope of the duties of such Officials. All such Department Heads shall attend meetings of the Commission by the request of the Commission of its duly authorized officials. Section IV. The Commission shall have the power and authority and it shall be its duties: (1) To make studies and project plans for the improvement of the City Of Huntsville, with a view of its developments and extension, and to recommend the City Council all matters for the development and advancement of the city fac ties, layouts and appearance, and to perform the duties imposed upon the Commissio by the Statutes of the State of Texas, and specifically by Article 974A, Vernon*, Annotated Revised Civil Statutes of Texas. (2) To make plans and maps of the whole or any portion of the City of Hunteville, and of land outside the City Limits located within five (5) milers of such City Limits, and any other land outside theCity of Huntsville which is thee opinion of the Commission bears a relation to the planning of the City of Huntsville and to make such changes in additions and extension of plans or maps within the City as it deems advisable. (3) To confer with and advise private property owners pertaining to location and erection of provate structures with the view of having the same conform with the overall City plan and to advise with the Building Inspector in the perfor- mance of his duties. (!t) To assist the City Council in the preparation of the City budget, and determination of the sources of funds in the procuring of financial and '\\11 other aids and assistance for the C%tjr from other govermental authorities and __ s their agencies for the purpose rein enumerated, if deemed advisable. k9\ (5) To assist and aides all other municipal and givernmental agencies including the City Council, in formulating and executing proper plans for municipal development. (6) To plan and recommend the location, planciand extent of City al ey4 ways, parks, playgrounds, airports, automobile parking places, and other pu e grounds and improvementa, for the location and planning of the public , schools, and other properties, and of publio utilities, including bus terminals, railroad depots and terminals, whether public or privately owned, for water, lights, sanitation, sewage disposal, drainage, flood obntrol, transportation, communication, and shipping facilities, and for the removal, relocation, widening, extension, narrowing, vacation, abandonment or change of use of any of the fore- going publio places, works, buildings, facilities and utilities. (7) To select and recommend to the City Council routes of streets and', avenues, and particularly to investigate and recommend the opening, widening, or abandon- ment of streets, avenues and alleyways, or the changing thereof to conform to the City's system, present and future, all streets, avenues, alleyways and parks. (8) To investigate, consider and report to the City Council upon the layout and plan of any new subdivision bo the City of Huntsville or property situated within five (5) miles of the City Limits and to approve all plane, plate or replete of additions within the City Limits or within five (5) miles of the City Limits. (9) To recommend to the City Council for adoption, rules and regulati¢na governing plats and subdivisions of land within the corporate limits of the City and within five (5) miles of the corporate limits of the City, and to promote health, safety, moral and general welfare of the community, and the safe and orderly and healthful development of the community, such rules and regulations as may be adopted by the City Council only after public hearing held thereon. (10) To recommend plans to the City Council for improving, developing, expanding and beautifying parks, lakes, and public buildings in or adjacent :to the City and to cooperate with the City Council and other agencies of the�City in devising, establishing, locating, improving, selecting, expanding and taining the public parka, playgrounds and lakes for public recreation. (11) To aid and assist the City Council by recommending plans for development of civic centers and to make investigations and consider and recommendations to the City Council concerning traffic regulations, rout and control, and highway designations. (12) To macro and recommend for adoption a master plan, as a whole or in parts, for the future development and redevelopment of the municipality and its environs and to prepare a comprehensive plan and ordinance for coning She City in accordance with Chapter 283, Acts of the Regular Session of the Legislature, 1927, and to perform such other duties as may be prescribed by ordinance pr State Lax. Section V. The Commission shall, subject to the approval of the City Council, make such rules and regulations and adopt such bylaws for its onw governmlent and designate such time and places for holding regular meetings as it deems proper. A majority of the members of the City Planning Commission shall constitute a quorum for transaction of business. Section VI. All ordinances and parts of ordinances inconsistent with or contrary hereto are hereby repealed. Section VII. If any section, subsection, sentence, clause, phrase, or portion of this ordinance is held invalid or unconstitutional by any sourt of competent jurisdiction, such section, subsection, sentence, clause, phrase or portion shall be deemed separate, distinct and an independent provision and such holding shall not effect the validity of the remaining portion hereof.
