ORD CC 11/10/1970 - Mobile Home regulationsAN ORDINANCE AMENDING SEC °SON III, SECTION VI, SECTION X AND SECTION XII, AND ADDING A NEW SECTION XII -A OF AN ORDINANCE HERE- TOFORE PASSED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, AS AMENDED, REFERRED TO AS THE MOBILE HOME AND MOBILE HOME PARK ORDINANCE RECORDED ON PAGES 287 -290 OF VOLUME J AND PAGES 3S/¢ 3.5sti OF VOLUME Ac OF THE OFFICIAL MINUTES OF THE CITY OF HUNTSVILLE, TEXAS: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, THAT: I. Section III, Section VI, Section X and Section XII of the Mobile Home and Mobile Home Park Ordinance as amende• as recorded in Volume J, Pages 287 -290 in Volume , Page ,)_ Y' of the Official Minutes of the City of H tsville, Texas, are hereby amended so that said Sec s of said Ordinance shall hereafter respective- ly read and become effective as follows: SECTION III: License fees: (a) Effective January 1, 1971, the annual license fee for each calendar year for each mobile home park shall be $25.00, plus $1.00 for each lot or area in such mobile home park maintained for rental space or a mobile home. Such fee shall be paid no later than January 15, 1971, and no later than January 15th cf each successive year thereafter so long as such mobile home park is operated as such. (b) Where an individual, partnership or corporation owns land and owns all mobile home units placed thereon, and the mobile home units are placed on permanent foundations and rendered for taxes as an improvement to the realty, such owner is exempt from payment of a license fee as a mobile home park. Such owner must, however, apply for and obtain a license without cost, and conform with all other applicable provisions of this ordinance. SECTION VI: SECTION X: Location: No mobile home park may be •located within the fire zone of the City. Mobile homes outside licensed park: It shall be un- lawful for any person to locate or maintain any such trailer in any place in the City of Huntsville or any place using the services of the City of Huntsville other than in a duly licensed and lawful mobile home park unless such person shall first secure a permit from a representative of the City Council upon written application therefor filed with the representative of the City Council, giving the name and address of the applicant and a description of the property upon which said mobile home is to be located. The permit required herein is in addition to the connection permit and inspection fee required in Section XII of the within ordinance. SECTION XII: Connection permit and inspection fee for mobile homes: (a) It shall be unlawful for any owner, operator or manager of a mobile home park to connect or allow any mobile home within a mobile home park to be connected to any sewer, gas, water or electrical connection without first obtaining a connection per - mit therefor. It shall likewise be unlawful for any mobile home owner located within the corporate limits of the City of Huntsville, whether in a mobile home park or otherwise, to connect a mobile home or cause same to be connected, to any sewer, gas, water or electrical connection without first obtaining a connection permit for such connection. (b) Connection permits shall be issued by the City Build- ing Inspector upon the payment of an inspection fee of $7.50. Thereafter, as soon as practical, the City Building. Inspector shall inspect the mobile home for which said permit was issued and if found to be properly connected to sewer, gas, water and electrical connection in accordance with applicable codes and ordinances of the City of Huntsville, including the within ordinance, he shall issue an inspection approval tag or sticker for affixing to the mobile home inspected. Such tag or sticker shall be displayed upon the front portion of said mobile home in such a manner as to be easily seen and shall remain so displayed so long as said mobile home remains connected to sewer, gas, water or electrical connections. (c) All applications for such connection permits shall be made upon forms provided by the City Building In- spector and shall contain the name of the mobile home owner, his mailing address, and a description of the mobile home for which said application is made. (d) When any mobile home is disconnected from sewer, gas, water or electrical connections and removed from any mobile home park, the City Building Inspector shall be informed so that the records pertaining to the inspection made under the permit issued for such mobile home may be removed from the active files maintained by the City Building Inspector. (e) Owners, operators or managers of mobile home parks' may apply for and be issued no more than five undesignated connection permits upon payment of the required inspection fee for each undesignated permit issued in order to facilitate connections for mobil homes during non- working hours of the City Building Inspector. When such permits are used, the City Building Inspector shall be furnished the usual information for a regular application upon the, next regular day of business and he shall thereupon complete the inspection and action required under the provisions in the above paragraphs. The City Building Inspector shall inspect mobile homes from time to time and is hereby authorized to require corrective action upon the part of the occupant or owner of any mobile home found to be improperly connected to sewer, gas, water or electrical connections. In the event any occupant or owner fails to comply with the corrective action required within three days after notice thereof, the City Building Inspector shall cause the termination of sewer, gas, water, or electrical service in the interest of the safety, health and welfare of the public until the deficiency is corrected. ( f ) • (g) The provisions of this Section shall apply to all mobile homes and mobile home parks from the effective date of the within amendment; provided however, that all mobile homes for which a parking permit has pre- viously been issued under the provisions of prior ordinances shall be inspected and an inspection tag issued without charge. All owners of mobile homes in use on the effective date of this ordinance for which no permit was obtained under prior ordinances shall comply with the provisions of sub - paragraph (b) above within 30 days from the effective date of the within ordinance. Thereafter, it shall be unlawful for any mobile home owner or mobile home park owner, operator or manager to allow any mobile home to re- main connected to sewer, gas, water or electrical connections within any mobile home park, or elsewhere within the jurisdictional limits of the City of Hunts - ville, which does not have a valid inspection tag or stun' (h) The owners of property upon which mobile homes are parked will pay a minimum monthly sewage and garbage charge of $2.75 for each mobile home parked upon his property plus the regulation metered water rate. II. The Mobile Home and Mobile Home Park Ordinance as amended as recorded in Volume J, Pages 287 -290 in Volume "a, Page ,' z of the Official Minutes of the City of ntsv111e, Texas, is hereby amended by adding a new Se ion to be numbered Section XII -A and which said Section shall read as follows: SECTION XII -A: Register and Directory Required: (a) All owners, operators or managers of mobile home parks shall maintain a register or listing of tenants occupying spaces within said mobile home park. Said register or listing shall be of a permanent type book or volume and shall contain the name of the tenant and the numbered space in which said tenant resides. Said register shall be kept and maintained for in- spection by City Officials at all times. (b) On January 5th and April 5th of 1971, and thereafter annually on January 5th and April 5th of each year each owner, operator or manager of a mobile home park shall furnish to the City Building Inspector of the City of Huntsville a complete listing of mobile home owners residing within their respective mobile home parks on January 1st and April 1st of each year, commencing on January 1, 1971. Such listing shall include the name of the owner of such mobile home and a description of the mobile home in which said person resides. (c) All owners, operators or managers of mobile home parks shall display, at the entrance of said mobile home park or the main office of said mobile' home parka complete M directory by numbered space of the names of all tenants of said mobile home park. Said directory may be upon a bulletin board protected from in- clement weather or any other suitable display, but of such prominence so that said directory may be utilized by police, fire department, emergency personnel or other persons seeking the location of individuals within said mobile home park. Said directory shall at all times be kept current in order to facilitate the location of tenants of said park. PASSED AND APPROVED IN OPEN COUNCIL this the hIrda of November, A. D., 1970.
