1. CALL TO ORDER
Mayor Pro Tern Johnson called the meeting to order at 5:32 pm. Mayor Woodward signed a Conflict of Interest form and did not
participate.
2. INVOCATION AND PLEDGES

4. STATUTORY AGENDA
a. Presentation, discussion, and possible action to authorize the Mayor, Interim City Manager,and/or City Manager
to apply for and accept, if awarded, and implement a request for an amendment to the Texas Department of
Emergency Management (TEDM)/FEMA for no more than an additional $1,850,810.00 for the Community Safe
Room; approve Resolution 2012-33 in support of same, 3rd reading; authorize Interim City Manager to sign
updated Memorandum of Understanding and use agreement with Walker County Boys & Girls Club for the

Mayor Pro Tern Johnson said he and Mr.Pinto had met with Jack Olsta the morning after the last meeting to discuss the
issue and that the Boys & Girls Club (BGC) had made an offer for the City to support the expanded project with no
additional expense over the 2009 agreement (see below for original, offer considered last week, and a second chart

Mayor Pro Tern Johnson noted this final (right chart) option would meet the City's additional in-kind and the BGC was
willing to sign agreements to protect the City from exposure. Councilmember Montgomery said she was relieved by the
offer due to the City's difficult financial climate, noting the need for such a shelter and the appropriateness of having the
BGC do their work in the center. She said she had received assurances from the BGC Board for their contribution.
Councilmember Fitch said he was also reassured but asked if the Council could move ahead to Executive Session to
address the legal questions they had.
5. EXECUTIVE SESSION
a. City Council will convene in closed session as authorized by Texas Government Code, Chapter 551, Section
551.071 —consultation with counsel on legal matters including, but not limited to, the proposed FEMA tornado
shelter project. [Leonard Schneider,City Attorney]
Councilmember Johnson adiourned the Council into Executive Session at 5:46 om.
O6. RECONVENE
a. Take action,if necessary,on items addressed during Executive Session.
The Council reconvened at 6:39 pm. Councilmember Olson moved to approve item 4a with the addition of a Deed
of Trust to secure the property and was seconded by Councilmember Humphrey. The motion passed
unanimously. 8-0. Mayor Woodward retook the dais.

9. ITEMS OF COMMUNITY INTEREST
(Hear announcements concerning items of community interest from the Mayor, Councilmembers,and City staff for
which no action will be discussed or taken.)
Councilmember Humphrey reminded all that the Battle of the Piney Woods would be this coming Saturday and the
Mayor noted it was also Fair on the Square. Dr. McKibben reminded all that the Dreyer's orchard of 22 trees was being
planted on October 12 at Emancipation Park.
10. ADJOURNMENT
Mayor Woodward adiourned the meeting at 6:42 p.m.
