ORD CC 06/09/1970 - Library Board AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF HUNTSVILLE, TEXAS, BY ADDING A SECTION CREATING A LIBRARY BOARD FOR THE CITY OF HUNTSVILLE, TEXAS, ESTABLISHING THE NUMBER OF MEMBERS, TERM OF APPOINTMENT, METHOD OF FILLING VACANCIES AND DEFINING THE POWERS AND DUTIES THEREOF BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, THAT�,THE CODE OR ORDINANCES, CITY OF HUNTSVILLE, TEXAS, IS HEREBY AMENDEDNBY ADDING A NEW CHAPTER TO--BE -NU ED-11A, _WHICH. SAID--49iAPTER SHALL READ AS FOLLOWS: CHAPTER 11A LIBRARIES Article I . In General, Section 11A-1 to 11A-5 SECTION 11A-1: Creation; Composition (a) There is hereby created and established a Library Board to be composed of 6 members. Such Board shall be officially designated as the Library Board of the City of Huntsville. (b) Each member shall be a resident citizen of the City of Huntsville at least one year prior to his appointment. Members of the Library Board shall serve without compensation, and no member shall serve more than 5 consecutive years. SECTION 11A-2: Appointment, Tenure (a) The original members of such Board shall be appointed by the Mayor by and with the advice and consent of the City Council. (b) Each member shall hold his office for a term of 3 years, except that of those first appointed, two shall hold office for terms of 1 year, and two other members shall hold office for a term of 2 years--the term of each to be determined by lot, and there- after their successors shall hold office for 3 years and until their successors are appointed. (c) The City Council shall at its first official meeting in the month of July in each year act upon appointments made to the Board by the Mayor in filling expired terms of members of the Board. SECTION 11A-3: Vacancies; Removal (a) Upon the death, resignation, removal or expiration of the term of office of any member of the Library Board, the remaining members of the Board shall recommend to the Mayor candidates for appointment to the Library Board. Such candidates for appoint- ment to the Library Board shall be determined by the Board based upon qualification experience and interest exhibited in the Huntsville Public Library and shall be sub- mitted to the Mayor as soon as practical after the vacancy occurs upon resignation or death and at least thirty (30) days prior to the expiration of the term of an appointed member of the Board, the Mayor, with the advice and consent of the City Council shall appoint the person selected by him to the unexpired term, if applicable and to the term of appointment if a new member. (b) Any member of the Library Board may be removed from office by the City Council for any cause deemed by the City Council sufficient for their removal in the interest of the public service. SECTION 11A-4: Election of Officers (a) The Library Board shall elect a President, a Vice-President and a Treasurer at its regular meeting in July after appointment. Such terms shall be for one year. (b) The Library Board shall meet at least once a month, and shall adopt such by-laws, rules and regulations as it deems best to govern its actions. (c) The presence of any 4 members at a meeting of the Board shall constitute a quorum. (d) The Librarian shall be Secretary of the Library Board and shall keep a record of all the proceedings of the Library Board, which record shall, upon request of the City Council be delivered to it for its inspection and review. (e) The Librarian shall be considered the executive officer of the Library Board and shall have sole charge of the administration of the Library with advice and review of the Board. The Librarian shall be held responsible for the care of the buildings and equipment, for employment and direction of the staff, for the effeciency of the Library service to the public, and for the operation of the library under the financial conditions set forth in the annual budget. The Librarian shall attend all Library Board meetings except those at which his appoint- ment, discharge, or salary is to be discussed. SECTION 11A-5: Powers and Duties (a) The Library Board shall encourage development of the public Library, and shall recommend and shall be responsible to the City Council for policies and programs for the advancement of the Library. -2- (b) The Library Board shall co-operate with all other public and private groups in advancing the best interests of the public Library and shall make all necessary rules, by-laws and regulations deemed by it necessary for the administration, govern- ment and protection of the Library system. (c) The Library Board shall review with the Librarian and make recommendations for the purchase of books, journals, publica- tions, furniture and fixtures and other necessary property, and to provide for the rebinding and preservation in proper order, the books, instruments, journals and other publications, and the property of the Library (d) The Library Board shall be responsible for interviewing applicants for the position of Librarian and shall make recommendations as to employment of the Librarian to the Mayor and the City Council. The Library Board may recommend the removal and dismissal of the Librarian. (e) The Library Board, with the assistance of the Librarian shall prepare its annual budget and present same to the Mayor at least thirty (30) days prior to the con- sideration of the annual budget of the City of Huntsville. (f) The Library Board shall have the authority, upon approval of the City Council, to make application and to participate in any State or Federal programs, to receive funds for the development of the Huntsville Public Library and to purchase books and materials for use in the Huntsville Public Library. (g) The Board shall render to the City Council quarterly reports of their operations and shall render such other reports and re- commendations to the City Council when re- quired in furthering the overall purpose of developing a public Library for the City of Huntsville.
