ORD CC 03/10/1970 - Paving PAVING ORDINANCE THE STATE OF TEXAS, X COUNTY OF WALKER, X CITY OF HUNTSVILLE. X BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS: WHEREAS, the City of Huntsville, Texas, acting under and by virtue of Title 28, Chapter 9, Revised Civil Statutes of the State of Texas of 1925, and all amendments thereof, particularly Article 1105b thereof, and by ordinance approved February 10, 1970 has determined that a necessity exits for and to make certain improve- ments hereinafter mentioned in the City of Huntsville, Walker County, Texas, as follows: UNIT At Normal Park Road from 22nd Street to Eastham Lane to be paved 36 ft. in width with concrete curb and gutter, 1�" asphalt surface with 4'k" asphalt base coarse. Same being a distance of 15, 642. 1 ft. , that is, 7,858. 1 ft. on the East Side and 7, 784.0, ft. on the West side. UNIT B: Lake Road between Highway 75 South and the Feeder Road of Interstate of Highway 45 to be paved 40 ft.asphalt surface with adequate base coarse (asphaltic, crushed stone, or iron ore gravel, depending on best bid) . Same being a distance of 8,347.21 ft. that is, 4,175.5 ft. on the East side and 4, 171.82 ft. on the West side. The pavement and improvement of said streets shall be done in accordance with plans and specifications to be prepared by N.B. Davidson, City Engineer, and approved by the Council, the paving and improvements shall consist of raising, lowering and grading of said streets, construction of storm drainage, concrete curbs and gutters, and paving Unit A with lk" asphalt surface with 4�" asphalt base coarse, and paving Unit B with 1k" asphalt surface with adequate base coarse (asphaltic, crushed stone, or iron ore gravel, depending on best bid) . The width of the pavement of said porthn of Unit A shall be 36 ft. , and the width of the pavement of said portion of Unit B shall be 40 ft. That not in excess of 3/4ths of the costs of the paving and improvements of said streets shall be paid by the abutting property owners ontthe front foot rule of plan. BE IT FURTHER ORDAINED that the estimate of the cost of such improvement, prepared by N.B. Davideon, City Engineer, and now on file with the Secretary of the City of Huntsville, Texas, heretofore prepared by him under the direction of the City Council, be, and the same is hereby approved. It is further ordained that a statement of the estimated amount of the assessment to be made against the owner or owners of claimants of abutting property against said property will be filed in the Office of the City Secretary, and the interested parties shall have the right to examine the same at all reasonable hours. Thr the estimated amount or amounts per front foot proposed to be assessed the owner or owners or claimants of abut- ting property shall not be in excess of $4.00 per front foot as follows: That the total estimated costs of the paving and improvements of the said Unit A to be improved is $168.720.00 and the estimated costs to the property owners is $62,568.40. That the total esimated costs of the paving and improvements of the said Unit B to be improved is $86,613 . 75 and the estimated costs to the property owners is $33,389.28. BE IT FURTHER ORDAINED that a hearing shall be heard by and before the City Council in the City Hall of the City of Huntsv- ville, Texas, on the 14th day of April, 1970, at 7:30 o'clock P.M. , as provided by law, at which time and place all persons interested in the paving and improvements, including the owner or owners of the property abutting said street or interest therein, of all persons owning, claiming and interested in said project may appear and be heard with reference to all matters pertaining to the pavement and improvements of said street, which hearing shall be continued from day to daytatil finally accomplished. No assessment shall be made against any abutting property, and its owner or owners thereof in excess of the special bene- fits to such property, and its owners, in the enhanced value thereof by means of such improvements as determined at such hearing. The City Secretary is hereby directed to giv* notice of said hearing be publishing a true copy of this ordinance in the Huntsville Item three (3) times, the first publishing to be at least 21 days before the day of hearing; and in addition written notice of the hearing shall be given by depositing in the United States Mail at least 14 days before the date of the hearing, wirtten notice of such hearing, postage prepaid, in an envelope addressed to the owners or the respective proper- ties abutting such street, as the names of such owners are shown on the then current rendered tax rolls of such city and at the addresses so shown, or if the names of such respective owners do not appear on such rendered tax roles, then addressed to such owners as their names are shown on the current un- rendered rolls of the City at the addresses shown thereon. All former ordinances and parts of ordinances in conflict herewith are hereby repealed. Upon motion duly made and seconded the above and foregoing ordinance was duly adopted by the unanimous vote of the City Council of the City of Huntsville, at its regular meeting held on the 10th day of March, 1970.
