ORD 1981-14 - Construction RequirementsORDINANCE NO. 81-14 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, ALTERING MINIMUM SET-BACK LINES FOR CONSTRUCTION OR PLACEMENT OF COMMERCIAL AND RESIDENTIAL BUILDINGS OR STRUCTURES IN THE DOWNTOWN COMMERCIAL AREA; PROVIDING A PENALTY; PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, THAT: Section 1: The Code of Ordinances of the City of Huntsville, Texas, Chapter 6, "Buildings," shall be amended by the adoption of a new section 6-4, that shall read as follows: Section 6-4. Set back requirements (a) No building permit shall be issued for the construction, erection or installation of a building or structure, or any part thereof, within twenty-five feet of the property line on the front side of the property. (b) No building permit shall be issued for the construction, erection or installation of a building or structure, or any part thereof, within five feet of any property line, drainage easement, or utility easement. (c) No building permit shall be issued for the construction, erection or installation of a building or structure, or any part thereof, within fifteen feet of any public street or street right-of-way. (d) The provisions of this section shall not apply to the downtown commercial area (Central Business District) within and bounded by Avenue J, 10th Street, Avenue N, and 15th Street, and within and bounded by University Avenue, 15th Street, Avenue M and 17th Street, except that no building permit shall be issued for the construction, erection or installation of a building or structure, or any part thereof, within ten feet of the front property line. Section 3: Any person, firm or corporation who shall violate any of the provisions of this Chapter, or who shall fail to comply with same shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not exceeding two hundred dollars ($200.00). Section 4: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regula- ting and governing the subject matter covered by this ordinance. Section 5: If any provision or part of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their applica- tion to other persons or sets of circumstances and to the end all pro- visions of this ordinance are declared to be severable. Section 6: This ordinance shall take effect immediately upon its publication.
