ORDINANCE NO. 80 -67
AN ORDINANCE AUTHORIZING PUBLICATION OF NOTICE OF INTENTION
TO ISSUE CERTIFICATES OF OBLIGATION FOR PROPOSED CHANGE
ORDER TO CONTRACT WITH CIRCLE DOUBLE "C" ENTERPRISES, INC.
FOR CONSTRUCTION OF INTERIOR ADDITIONS AND IMPROVEMENTS TO
THE POLICE AND MUNICIPAL COURTS BUILDING; AND MAKING VARIOUS
PROVISIONS RELATED THERETO.
WHEREAS City Council finds it necessary to enter into a change order to a
contract with Circle Double "C" Enterprises, Inc. for construction of
interior additions and improvements to the police and municipal courts
building;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, that:
Section 1: The City Secretary is hereby authorized and directed to cause
to be published a notice to issue Certificates of Obligation in sub-
stantially the following form:
NOTICE OF INTENTION
TO ISSUE CERTIFICATES OF OBLIGATION
NOTICE IS HEREBY GIVEN that the City of Huntsville, Texas, proposes
to authorize issuance of Certificates of Obligation, in accordance
with the terms and provisions of this notice for the purpose of
funding a change order to contract with Circle Double "C" Enterprises,
Inc. for construction of interior additions and improvements to the
police and municipal courts building,, at its regular Council meeting
at the Huntsville City Hall, Tuesday, December 2, 1980, at 7:00 p.m.,
or at subsequent meeting of Council.
It is the intention of the City to pay all or any part of any con-
tractual obligation to be incurred for such change order by the
issuance of Certificates of Obligation of the City pursuant to Texas
Revised Civil Statutes, Art. 2368a.1 and payable from City ad valorem
taxes, in the maximum aggregate principal amount of $30,000.00, bear-
ing interest at a rate not in excess of that prescribe by'1 xas
Revised Civil Statutes, Art. 717k -2, and maturing over a period of
years not to exceed 20 years from the date hereof.
Section 2: The notice set forth in Section 1 shall be published once a week
for two (2) consecutive weeks in a paper that is of general circulation
in the City of Huntsville and that has been duly designated as the
official newspaper of the City. The date of the first publication
shall not be less than fourteen (14) days prior to the date set in
said notice.
Section 3: It is hereby officially found and determined that the need of
the City for such contract change order and such financing creates an
emergency and an urgent public necessity for the consideration of the
adoption of this ordinance in accordance with the notice of meeting
relating hereto.
Section 4: This ordinance shall take effect immediately upon its passage.
