ORD CC 07/17/28 - Tax for StreetsTHE STATE OF TEXAS ) COUNTY OF ':TALKER ) CITY OF HUNTSVILLE ) On this /7 _day of 1928, the City Cour i1 of the City of H sville, Texas, was convened in session in the City Hall of said City, with the Mayor and all other members and the City Secretary present, when there came on to be considered the matter of determining the neceesity of street improvements for said city, and after due consideration, Alderman ordinance entitled: introduced an "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, DETERMINING THE NECESSITY FOR STREET IMPROVEMENTS AND DI RECTING THAT SUCH STREET IMPROVEMENTS BE MADE AND LEVYING A TAX IN PAYMENT THEREOF; AND DECLARING AN EMERGENCY. " It was move by Alderman _ and seconded by Alderman t the ordinance be read in full, which motion was carried by unanimous vote, and the ordinance was read in full by the City Secretary. It was moved by Alderman xi and seconded by Alderman that the ordinance pass its first reading, which motion was carried ,by the following vote: AYES: NOS: None. The ordinance was read a third tine, and it was moved by Alderman and seconded by Alderman that it pass its third and final reading, h motion was carried by the following te: AYES: NOS: None. Thereupon the Mayor declared the ordinance finally passed. The ordinance follows: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, DETERMINING THE NECESSITY FOR STREET IMPROVEMENTS AND DIRECTING THAT SUCH STREET IMPROVEMENTS BE MADE AND LEVYING A TAX IN PAYMENT THEREOF; AND DECLARING AN EMERGENCY." It appearing to the Council that the City of Huntsville is in need of additional street improvements, and that provision should be made for the construction and improvement of the streets of said city, and that it is estimated that the cost of such additional street improvements will be approximately 3tYfI!..& and that it is to the advantage of the city that a portion of such expense should be paid for out of the funds derived from taxation for future years; THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS; that it I That it is hereby determined to be to the advantage of the City of Huntsville and the taxpayers thereof, that such street improvements should be made, and it is hereby directed that such street improvements shall be made under the further direction of this Council. II THEREFORE, BE IT FURTHER ORDAINED by the City Council of the City of Huntsville, ,Texas, that there be and there is hereby levied a tax of tJC cents on each $100.00 valuation of taxable property in said city, or so much thereof as may be necessary for such purpose for the year 1928 and for each succeeding year while such indebtedness or any portion thereof may be outstanding, for the purpose of paying for approximately 4e;3i_ 11/ 4` .,street improvements to be con- structed in said City under the direction of this Council, and such tax shall be assessed and collected at the time and in the manner that other taxes are assessed and collected, but it is expressly understood that any balance of funds de- rived from such tax over and above the amount necessary to pay for such street improvements, is left unappropriated and subject to appropriation to such of the city funds as this Council may decide at any time after pay for such street improvements or the annual proportionate part thereof shall be made. The fact that the City of Huntsville is in immediate need of such street improvements herein described creates an emergency and an imperative necessity that the rule requiring ordinances to be passed at more than one meeting be suspended, and said rule is hereby suspended, and that this ordinance shall take effect and be in force from and after its passage, and it is so ordained.
