ORD CC 10/07/48 - Trucks and Tractors StoppedAN ORDINANCE PROHIBITING THE STOPPING; PARKING OR LEAVING STANDING OF TRUCKS, TRUCK TRACTORS AND TRAIL- ERS ON CERTAIN STREETS AND AVENUES WITHIN THE CITY OF HUNTSVILLE, TEXAS; EXCEPTING THE DRIVERS OF SUCH VEHICLES FROM THE OPERATION OF SUCH ORDINANCE IN CER- TAIN CASES; PROVIDING FOR THE ENFORCEMENT OF THL OR- DINANCE AND FIXING THE PENALTY BE IT ORDAINED BY THE CITY COUNCIL OF THh CITY OF HUNTSVILLE, TEXAS: SECTION 1: No person, firm, association or corporation shall stop, park or leave standing, whether attended or unattend- ed, any truck or truck tractor having a registered gross weight of six thousand (6,000) lbs. or more, or any trailer, semi- trail- er, pole trailer or house trailer, having a registered gross weight of four thousand (4,000) lbs. or more, or any combination of truck and trailer having a combined registered gross weight of eight thou- sand (8,000) lbs. or more, upon any of the following streets or avenues within the City of Huntsville, Texas, namely: Tenth Street from Avenue J to Avenue M, inclusive, ..s Eleventh Street from Avenue H to the City Limits, in- clusive, Twelfth Street from Avenue J to Avenue M, inclusive, Thirteenth Street from Avenue J to Avenue M, inclus- ive, Avenue J from Tenth Street to Thirteenth Street, in- clusive, Avenue K from highth Street to Fourteenth Street, in- clusive, Avenue L from Eighth Street to Fourteenth Street, in- clusive, Avenue M from Tenth Street to Thirteenth Street, in- clusive. SECTION 2: The provisions of Section 1 shall not apply to the driver of any such vehicle where: 1. Such vehicle becomes disabled while on any such street or avenue in such manner and to such extent that it is impossible - 1 - to avoid stopping and temporarily leaving such disabled vehicle in such position, provided such vehicle is removed from such street or avenue within one (1) hour after the same becomes so disabled. 2. Such vehicle is stopped, parked or left standing for the purpose of selling, delivering and unloading commodities at commercial business establishments, or for the purpose of load- ing, unloading and delivering of commodities sold by commercial business establishments or for the purpose of loading, unloading, receiving and delivering of goods, packages or commodities shipped or transported to or from residences or businesses, provided in any of such cases such vehicle shall not be stopped, parked or left standing at any such residence or business house longer than a period of one (1) hour. 3. Such truck or semi -truck is not attached to a trail- er, semi- trailer, pole trailer or house trailer, and is being used as a private passenger vehicle. SECTION 3: Any person, firm, association or corpora- tion violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction therefor be fined any sum of money not in excess of One Hundred 0;100.00) Dol- lars. SECTION 4: If any part or parts of this ordinance shall be held to be unconstitutional or void, the same shall not affect the validity of the remaining parts of the ordinance. The Council hereby declares that it would have passed the remaining parts of this ordinance if it had known that any part or parts thereof would be declared unconstitutional or void. SECTION 5: This ordinance shall become effective im- - 2 - mediately after its publication as required by law, and it is so ordered. APPROVED in open council this /,) day of October, 1948.
