ORD CC 07/01/47 - Bond Issuance (2)THE STATE OF TEXAS 0 COUNTY OF WALKLR 0 CITY OF HUNTSVILLE 0 WHEREAS, the City Council of the City of Huntsville, Texas, deem it advisable to issue the bonds of said City for the purposes hereinafter mentioned: THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTS- VILLE, TEXAS IN COUNCIL ASSEYBLED: That an election be held within said City on the 29th day of July, 1947, at which election the following proposition shall be submitted to the qualified property taxpaying voters residing with- in and entitled to vote at said election within said City of Hunts- ville, to-wit: FIRST PROPOSITION: Shall the City Council of the City of Huntsville, Texas, be authorized to issue the bonds of the City of Huntsville, Texas, in the principal sum of Ninety Thousand (e90,000.00) Dol-ars, payable and maturing sericlly within a given number of years beginning not more than five (5) years after the dote thereof, and extending over a period of not to exceed forty (40) years from and after the dote thereof, within the discretion of the City Council of said City, bearing interest at the rate of not exceeding three and one-half (3*) per cent per annum, payable annually or semi-annuary, at the discretion of srid Council, and to levy a tax sufficient to pay the interest on said bonds and to create a sinking fund sufficient to redeem them at maturity for the purpose of m rovin and jin accudance e an as au orized by Ar c e e Revised Civil Statutes of the State of Texas of 1925, and the amendments thereto, and in accordance with and as authorized by Title 28 of the Revised Civil Statutes of the State of Texas of 1925, and the amend- ments thereto, and in accordance with the Constitution and Laws of the State of Texas. SECOND PROPOSITION: Shall the City Council of the City of Huntsville, Texas be authorized to issue the bonds of the City of Huntsville, Texas, in the principal sum of Fifty Thousand ($50,000.00) Dollars, payable and maturing serially within e given number of years beginning not more than five (5) years after the date thereof, and extending over a period of not to exceed forty (40) years from end after the date thereof, -within the discretion of the City Council of said City, bearing interest at the rate of not exceeding three and one-half (3*) per cent per annum, payable annually or semi-annually, in the discretion of said Council, end to levy a tax sufficient to pay the interest on said bonds and to create a sinking fund sufficient to redeem them at illturity for the purpose of y resurfacing the same, or any part there- 3T and paving the same, or any part thereof, with concrete, rock, gravel or asphalt, or in aid thereof, and to pay the City's pro- portionate part, or all, of the cost of such street improvements and repairs within the discretion of said Council to be made under the front foot rule or plan, or otherwise, in accordance with and as authorized by Title 28 of the Revised Civil Statutes of the State - 1 - of Texas of 1925, and the amendments thereto, end in accordance with the Constitution and Laws of the State of Texas. THIRD PROPOSITION: Shall the City Council of the City of Huntsville, Texes, be authorized to issue the bonds of the City of Huntsville, Texas, in the principal sum of Fifteen Thousand ($15,000.00) Dollars, payable and maturing serially within a given number of years beginning not more than five (5) years after the date thereof, and extending over a period of not exceeding forty (40) years from and after the date thereof, within the discretion of the City Council of seid City, bearing interest at the rate of not exceeding three and one-half (3-) per cent per annum, payable annually or semi-annualay, in the discretion of seid Council, and to levy a tax sufficient to pay the interest on said bonds and to create a sinking fund sufficient to redeem them at maturity for the purpose of cutting down and redu._ t 7 0. ourt ouse r • ; 0 IA* a acent there o and of making permanent im 11 • 'ft' •• • d e • IIVAIR•1111111•MtitILAialliarn.. av ng t e same vil =lore e, re 'el -grave or asp alt, or in aid thereof, and to pay the City's proportionate part, or all, of the cost of such street improvements within the discretion of said Council to be made under the front foot rule or plan, or otherwise, in accordance with and es authorized by Title 28 of the Revised Civil Statutes of the State of Texes of 1925, and the amendments thereto, and in accordance with the Constitution and Laws of the State of Texas. Said election shall be held at the City hall and Fire Sta- tion, within the City of Huntsville, Texas, and the following named persons are hereby appointed officers of said election, to-wit: Chas. B. Fadell, as Manager and Judge, and J. Sam Angier and H. O. Leigh, as Clerks. Said election shall be held under the provisions of Title 22 of the Revised Civil tatutes of the State of Texas of 1925, and the amendments thereto, and the Constitution and Laws of the State of Texas, and only qualified voters who are property tax- payers of said City shell be allowed to vote at said election. tll voters who favor the FIRST PROPOSITION to issue the bonds and levy the tax shall have written or printed on their ballots the words: "FOR THE ISSUANCE OF THE AIRPORT BONDS AND THE LEVY OF THE TAX", and those opposed to the FIRST PROPOSITION shall have writ- ten or pr7nted on tkier ballots the words: "AGAINST THE ISSUANCE OF THE AIRPORT BONDS AND THE LEVY OF THE TAX". ,11 voters who favor the SECOND PROPOSITION to issue the bonds and levy the tax shall have written or printed on their ballots: "FOR THE ISSUANCE OF THE STREET IMPROVEMENT BONDS AND THE LEV7 OF THE TAX", and those opposed to the SECOND PROPOSITION shall have written or printed on Their ballots the words: "AGAINST TEE ISSUANCE OF TEE 0TREET IMPROVEMENT BONDS AND THE LEVY or THL TAX". All voters who favor the THIRD PROPOSI- TION to issue the bonds and levy the tax shall have written or printed on their ballots the words: "FOR THE ISSUANCE OF TEE COURTH')USE YARD BONDS AND THE LEVY OF THE TAX", and those opposed to the THIRD PROPO- SITION shall have written or printed on their ballots: "AGAINST THE ISSUANCE OF ThE COURTH USE YARD BONDS AND THE L VY OF THE TAX". The manner of holding said election shell be governed by the General Laws of the State of Texes regulating elections. A copy of this ordinance signed by the Hon. Wilbourn S. Gibbs, Mayor of the City of Huntsville, Texas, and attested by Kate Derr Ross, City Secretary of said City, A.th the seal of said City affixed thereto, shall serve as proper notice of said elec- tion. I:otice of said election shall be given by posting a sub- stantial copy of this election order in each of the wards of the City of Huntsville, Texas, and also at the City Hr11 and Fire Sta- tion within said City. Such notice shal] also be published on the same day in e; ch of two (2) successive weeks in a newspaper of gen- eral circulation published within said City, the date of the first publication to be not less than fourteen (14) days prior to the date set for said election. The provisions of Article 704 of the Revised Civil Statutes of the State of Texas, as amended, -MA.] control over any City Charter provisions to the contrary. This ordinance shall take effect upon its adoption by the City Council and upon its approval by the Mayor of said City of Hunts- ville, Texas. The foregoing ordinance was Submitted to the Comleittee on Streets and Bridges and to the airport Committee at a regular ses- sion thereof held on this 1st day of July, 1947. MAYOR, CITY OF HUNTVILLE, TEXAS the undersigned Committee on Streets and Bridges of the City Council of Huntsville, Texas, end the Airport Committee of the City Council of Huntsville, Texas, to arch of whom the above and foregoing ordinance was referred, having duly considered the same, do hereby severally report said ordinance back to the Council with the recommendation that the same be adopted with the emergency clause putting this ordinance into effect upon its adoption and approval.
