V ilbourn S. Gibbs, Mayor, L. T. Rob- inson, Sam Robbins, 'ilbur L. Smither, J. N. Scarborough, Victor Randel and J. O. Thompson, Aldermen, end Kate Barr Ross, City sec- retary, when among other proceedings had wE s the following ordi- nance duly adopted upon motion end duly accepted by unanimous vote of all members present, to- ;grit: INHERLAS, the City Council of the City of Huntsville, Texas, deem it advisable to issue the bonds of said City for the purposes hereinafter mentioned: THEREFORE, BE IT ORDAINa_..D BY TEL CITY COUNCIL OF THE CITY OF HULTS- VILLE, TEXAS IN COUNCIL ASSEMBLED: That an election be held within said City on the 29th day of July, 1947, at which election the following proposition shall be submitted to the qualified property taxpaying voters residing with- in and entitled to vote et seid election within said City of Hunts- ville, to -wit: FIRST PROPOSITION: Shall the City Council of the City of Huntsville, Texas, be authorized to issue the bonds of the City of Huntsville, Texas, in the principal sum of Ninety Thousand ($90,000.00) Dollars, payable and maturing serially within e given number of years beginning not more than five (5) years after the date thereof, and extending over a period of not to exceed forty (40) years from and after the date thereof, within the discretion of the City Council of said City, bearing interest at the rate of not exceeding three end one -half (32) per cent per annum, payable annually or semi - annually, et the discretion of said Council, and to levy a tax sufficient to pay the interest on said bonds and to create a sinking fund sufficient to redeem them at maturity for the purpose of improving and equipping the Huntsville Municipal Airport in accordance with and as authorized by Article 1269h of the Re- vised Civil Statutes of the State of Texas of 1925, and the amend- ments thereto, and in accordance with and as authorized by Title 28 of the Revised Civil Statutes of the State of Texas of 192.5, and the amendments thereto, and in accordance with the Constitution and Laws of the State of Texas. SECOND PROPOSITIOi: Shall the City Council of the City of Huntsville, Texas be authorized to issue the bonds of the City of Huntsville, Texas, in the principal sum of Fifty Thousand ($50,000.00) Dollars, payable and maturing serially within a given number of years beginning not more than five (5) years after the date thereof, end extending over a period of not to exceed forty (40) years from and after the date thereof, ?within the discretion of the City Council of said City, bearing interest et the rate of not exceeding three and one -half (32) per cent per annum, payable annually or semi - annually, in the discretion of said Council, and, to levy a tax sufficient to pay the interest on said bonds and to 1 7 1 create a sinking fund sufficient to redeem there at maturity for the purpose of making permanent improvements upon the streets of said City of Huntsville by resurfacing the same, or any part there- of, and paving the same, or any part thereof, with concrete, rock, gravel or asphalt, or in aid thereof, and to pay the City's propor- tionate part, or all, of the cost of such street improvements and repairs within the discretion of said Council to be made under the front foot rule or plan, or otherwise, in accordance 'with and as authorized by Title 28 of the Revised Civil Statutes of the State of Texas of 1925, and the amendments thereto, and in accordance with the Constitution and Lars of the State of Texas. `HI]) PROPOSITION: Shall the City Council of the City of Huntsville, Texas, be authorized to issue the bonds of the City of Huntsville, Texas, in the principal sum of Fifteen Thousand Gp15,000.00) Dollars, payable and maturing serially within a given number of years beginning not more than five (5) years after the date thereof, and extending over a period of not exceeding forty (40) years from and after the date thereof, rithin the discretion of the City Council of said City, bearing interest at the rate of not exceeding three and one -half (32) per cent per annum, payable annually or semi- annually, in the discretion of said Council, and to levy a tax sufficient to pay the interest on said bonds, and to create a sinking fund sufficient to redeem them at maturity for the purpose of cutting down and reducing the size of the courthouse yard in said City and of increasing the width of the streets adja- cent thereto and of making permanent improvements upon the vaidened streets of said City of Huntsville by paving the same with concrete, rock, gravel or asphalt, or in adi thereof, and to pay the City's proportionate part, or all, of the cost of such street improvements within the discretion of said Council to be made under the front foot rule or plan, or otherwise, in accordance with and as authorized by Title 23 of the Revised Civil Statutes of the State of Texas of 1925, and the amendments thereto, anu in accordance with the Consti- tution and Laws of the State of Texas. Said election shall be held at the City Hall and Fire Station, within the City of Huntsville, Texas, and the following named persons are hereby appointed officers of said election, to- wit: Chas. B. Fadell, as ::anager and Judge, and J. Sam Angier and H. O. Leigh, as Clerks. Said election shall be held under the pro- visions of Title 22 of the Revised Civil Statutes of the State of Texas of 1925, and the amendments thereto, and the Constitution and Laws of the State of Texas, and only qualified voters who ere prop- erty taxpayers of said City shall_ be allowed to vote at said elec- tion. All voters who favor the FIRST PROPOSITION to issue the bonds and levy the tax shall have written or printed on their ballots the words: "FOR ThE ISSUANCE OF IHE AIRPORT BOLDS AND Th L-EVY OF THE TAX ", and those opposed to the FIi:ST PROPOSITION shall have written or printed on their ballots the ;lords: "AGE INsT TFIL ISSUANCL OF THL AIRPORT BONDS AND THE LEVY OF THE TAX ". !la voters who favor the SLC'ND PROPOSITICN to issue the bonds and levy the tax shall have written or printed on their ballots: "FoR `1't ISSUAiiCL OF lin. ST u n.T IXPROVI,L T BONDS AND THE LEVY OF THE TAX ", and those opposed to the SLCOND PROPOSITION shall have :written or printed on their ballots the words: "AGAIN sT TEL ISSUALCL OF TEL STREET I .IPRO VELENT BONDS AND TEL LLVY OF Ti.E TAX". All voters who favor the THIRD PI.OPOSITION to - 2 - 1 issue the bonds and levy the tax shall have aritten or printed on their ballots the words: "FOR THE ISSUALCE OF ThL COURTHOUSE YARD BUDS AID ' i :r; LEVY OF Thh TAX ", and those opposed to the THIED POPOSITION shall have aritten or printed on their ballots: "AGAINST THE ISSUANCE OF TLL COUIiTt -iOesE Yi LD BONDS Ai D lsiL LJVY OF THL TAX". The manner of holdi: -g said election shall be governed by the General Laws of the State of Texas regulating elections. A copy of this ordinance signed by the hon. wilbourn S. Gibbs, I: ?ayor of the City of Huntsville, Texas, end attested by Kate Barr �_ass, City Secretary of said City, with the seal of said City affixed thereto, shall serve es proper notice of said election. Notice of said election shall be given by posting e sub- stantial copy of this election order in each of the wards of the City of Huntsville, Texas, and also at the City Hall and Fire Sta- tion within said City. Such notice shall also be published on the same day in each of t:ro (2) successive ;reeks in a newspaper of general circulation published drithin said City, the date of the first publication to be not less than fourteen (14) days prior to the date set ... for said election. The provisions. of Article 704 of the Revised Civil Statutes of the etate of Texas, as amended, shall control over any City Charter provisions to the contrary. This ordinance shall take ef`ect upon its adoption by the City Council and upon its approval by the iiayor• of said City of Huntsville, Texas. The foregoing ordinance was submitted to the Committee on Streets and Bridges and to the cirport Committee at a regular session thereof held on this lst day of July, 1947. IILBOUtN S.
