ORD CC 07/01/47 - Bond IssuanceTHE STATE OF 'TEXAS COUNTY OF WALTER CITY OF HTJ TSVILLE WHEREAS, the City Council of the City of Huntsville, Texas, deem it advisable to issue the bonds of said City for the purposes hereinafter mentioned: THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTS - VILLE, TEXAS, IN COUNCIL ASSEMBLED: That an election be held within said City on the 29th day of July, 1947, at which election the following proposition shall be submitted to the qualified property taxpaying voters residing with- in and entitled to vote at said election within said City of Hunts- ville, to wit: FIRST PROPOSITION: Shall the City Council of the City of Huntsville, Texas, be authorized to issue the bonds of the City of Huntsville, Texas, in the principal sum of Ninety Thousand ($90,000.00) Dollars, payable and maturing serially within a given number of years beginning not more than five (5) years after the date thereof, and extending over a period of not to exceed forty (40) years from and after the date thereof, within the discretion of the City Council of said City, bearing interest at the rate of not exceeding three and one -half (32) per cent per annum, payable annually or semi - annually, at the discretion of said Council, and to levy a tax sufficient to pay the interest on said bonds and to create a sinking fund sufficient to redeem them at maturity for the purpose of improving and equipping the Huntsville Municipal Airport in accordance with and as authorized by Article 1269h of the Revised Civil Statutes of the State of Texas of 1925, and the amendments there- to, and in accordance with and as authorized by Title 28 of the Revised Civil Statutes of the State of Texas of 192'5, and the amendments there- to, and in accordance with the Constitution and Laws of the State of Texas. SECOND PROPOSITION: Shall the City Council of the City of Huntsville, Texas be authorized to issue the bonds of the City of Hunts- ville, Texas, in the principal sum of Fifty Thousand (550,000.00) Dol- lars, payable and maturing serially within a given number of years be- ginning not more than five (5) years after the date thereof, and ex- tending over a period of not to exceed forty (40) years from and af- ter the date thereof, within the discretion of the City Council of said City, bearing interest at the rate of not exceeding three and one -half (3-) per cent per annum, payable annually or semi - annually, in the discretion of said Council, and to levy e tax sufficient to pay the interest on said bonds and to create a sinking fund suffi- cient to redeem them at maturity for the purpose of making permanent improvements upon the streets of said City of Huntsville by resur- facing the same, or any part thereof, and paving the same, or any pert thereof, with concrete, rock, gravel or asphalt, or in aid there- of, and to pay the City's proportionate part, or all, of the cost of such street improvements and repairs within the discretion of said Council to be made under the front foot rule or plan, or otherwise, in accordance with and as authorized by Title 28 of the Revised Civil Statutes of the State of Texas of 1925, and the amendments thereto, and in accordance with the Constitution and Laws of the State of Texas. - 1 - THIRD PROPOSITION: Shall the City Council of the City of Huntsville, Texas, be authorized to issue the bonds of the City of Huntsville, Texas, in the principal sum of Fifteen Thousand ($15,000.00) Dollars, payable and maturing serially within a given number of years beginning not more than five (5) years after the date thereof, and extending over a period of not exceeding forty (40) years from and after the date thereof, within the discretion of the City Council of said City, bearing interest at the rate of not exceeding three and one -half (3*) per cent per annum, payable annually or semi - annually, in the discretion of said Council, and to levy a tax sufficient to pay the interest on said bonds and to create a sinking fund sufficient to redeem them at maturity for the purpose of cutting down and reducing the size of the court- house yard in said City and of increasing the width of the streets adjacent thereto and of making permanent improvements upon the wid- ened streets of said City of Huntsville by paving the same with con- crete, rock, gravel or asphalt, or in aid thereof, and to pay the City's proportionate part, or all, of the cost of such street im- provements within the discretion of said Council to be made under the front foot rule or plan, or otherwise, in accordance with and as authorized by Title 28 of the Revised Civil Statutes of the State of Texas of 1925, and the amendments thereto, and in accord- ance with the Constitution and Laws of the State of Texas. Said election shall be held at the City Hall and Fire Sta- tion, within the City of Huntsville, Texas, and the following named persons are hereby appointed officers of said election, to -wit: Chas. B. Frdell, as Manager and Judge, and J. Sam Angier and H. 0. Leigh, as Clerks. Said election shall be held under the provisions of Title 22 of the Revised Civil Statutes of the State of Texas of 1925, and the amendments thereto, and the Constitution and Laws of the State of Texas, and only qualified voters who are property tax- payers of said City shall be allowed to vote at said election. All voters who favor the FIRST PROPOSITION to issue the bonds and levy the tax shall have written or printed on their ballots the words: "FOR THE ISSUANCE OF THE AIRPORT BONDS AND THE LEVY OF THE TAX ", and those opposed to the FIRST PROPOSITION shall have writ- ten or printed on their ballots the words: "AGAINST THE ISSUANCE OF THE AIRPORT BONDS AND THE LEVY OF THE TAX ". All voters who favor the SECOND PROPOSITION to issue the bonds and levy the tax shall have written or printed on their ballots: "FOR THE ISSUANCE OF THE STREET IMPROVEMENT BONDS AND THE LEVY OF THE TAX ", and those opposed to the SECOND PROPOSITION shall have written or printed on their ballots the words: "AGAINST THE ISSUANCE OF THE STREET IMPROVEMENT BONDS AND THE LEVY OF THE TAX ". All voters who favor the THIRD PROPOSI- TION to issue the bonds and levy the tax shall have written or printed on their ballots the words: "FOR THE ISSUANCE OF THE COURTHOUSE YARD BONDS AND THE LEVY OF THE TAX ", and those opposed to the THIRD PROPO- SITION shall have written or printed on their ballots: "AGAINST THE ISSUANCE OF THE COURTHOUSE YARD BONDS AND THE LEVY OF THE TAX ". The manner of holding said election shall be governed by the General Laws of the State of Texas regulating elections. A copy of this ordinance signed by the Hon. Wilbourn S. Gibbs, Mayor of the City of Huntsville, Texas, and attested by Kate Barr Ross, City Secretary of said City, with the seal of said - 2 - City affixed thereto, shall_ serve as proper notice of said elec- tion. Notice of said election shall be given by posting a sub- stantial copy of this election order in each of the wards of the City of Huntsville, Texas, and also at the City Hall and Fire Sta- tion within said City. Such notice shall also be published on the same day in each of two (2) successive weeks in a newspaper of gen- eral circulation published within said City, the date of the first publication to be not less than fourteen (14) days prior to the date set for said election. The provisions of Article 704 of the Revised Civil Statutes of the State of Texas, as amended, shall control over any City Charter provisions to the contrary. This ordinance shall take effect upon its adoption by the City Council and upon its approval by the Mayor of said City of Hunts- ville, Texas. The foregoing ordinance was submitted to the Committee on Streets and Bridges and to the Airport Committee at a regular ses- sion thereof held on this 1st day of July, 1947. /s/ Wilbourn S.
