A RESOLUTION OF THE CITY COUNCIL, OF THE CITY OF HUNTSVILLE, TEXAS,
AUTHORIZING THE MAYOR TO SIGN AN ADVANCED FUNDING AGREEMENT WITH
THE TEXAS DEPARTMENT OF TRANSPORTATION FOR THE RELOCATION OF AN
EXISTING CURB INLET AND NEW STORM SEWER PIPE REQUIRED TO ACCOMPLISH
THIS RELOCATION; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Huntsville, Texas is required to design and construct relocation of existing curb
inlet, including new storm sewer pipe required to accomplish this relocation located on Highway 75
South of Sycamore Street for the purpose of providing a right turn lane (the "Project") and
WHEREAS, the City and the State have agreed upon a plan to construct relocation of existing curb inlet
and new storm sewer pipe; and
WHEREAS, detailed construction plans have been prepared; and
WHEREAS, the City will bid the Troject to contract, administer and inspect the construction, and fund
the construction of the Project; and
WHEREAS, the Texas Department of Transportation permits construction to be performed in their rights -
of -way following the execution of an Advanced Funding Agreement between the City of Huntsville and
the Texas of Department of Transportation; and
WHEREAS, there will be no funding or reimbursements from the Texas Department of Transportation
for any of the Project costs; now therefore,
PART 1: The matters set forth in the preamble are true and correct.
PART 2: The City Council of the City of Huntsville agrees to execute an Advanced Funding Agreement
with the Texas Department of Transportation, which will permit the City to perform work
within the State right -of -way.
PART 3: The City Council of the City of Huntsville hereby authorizes the Mayor to execute said
Advanced Funding Agreement on behalf of the City of Huntsville, Texas and to transmit the
some to the State of Texas for appropriate action.
PART 4: This Resolution shall be effective immediately upon its adoption.
