ORD CC 11/09/76 - Equipment PurchaseORDINANCE NO. 76 -21 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, CONFIRMING THE PURCHASE OF SANITATION EQUIPMENT AND FURTHER CONFIRMING AND DETERMINING THAT A NECESSITY EXISTS THAT PAYMENT OF THE PURCHASE PRICE FOR SUCH EQUIPMENT SHALL BE BY CERTIFICATE OF OBLIGATION, DETERMINING AND RECONFIRMING THAT AT THE TIME SUCH EQUIPMENT WAS AUTHORIZED TO BE PURCHASED AN EMERGENCY EXISTED, AND STILL EXISTS, AND THAT BY VIRTUE OF SUCH PAST AND PRESENT EMERGENCY THAT THE REQUIREMENT FOR THE ADVERTISEMENT FOR BIDS AND FOR NOTICE OF INTENTION TO ISSUE CERTIFICATES OF OBLIGATION WAS AND IS DISPENSED WITH AS AUTHORIZED BY LAW, AND OTHERWISE CONFIRMING AND AUTHORIZING THE METHOD OF PAYMENT FOR SUCH EQUIPMENT. WHEREAS, the City of Huntsville has heretofore negotiated with Scott Holman Company, Inc. for the purchase of two new 1976 Ford Cab and Chassis and two new Cobey Fork Tainer Front Loading Refuse Compact- ion Bodies to be used within the Sanitation Department of the City of Huntsville; and, WHEREAS, the City Council of the City of Huntsville has here- tofore on October 6, 1976, officially determined that an emergency existed which authorized the City to negotiate directly with Scott Holman Company, Inc. for the purchase of such equipment without the necessity of the advertisement for bids and that such emergency also authorized the issuance of Certificates of Obligation without the publication of the necessary notice of intent to issue Certificates of Obligation, which emergency determination was in the best interest of the City of Huntsville and was necessary to protect and provide for the public health and welfare; NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Huntsville, Texas: Section 1: That the City of Huntsville confirms the negotiation of contract between the said City and Scott Holman Company, Inc., for the purchase of two new 1976 Ford Cab and Chassis and two new Cobey Fork Tainer Front Loading Refuse Compaction Bodies for immediate delivery for a total contract cost of $100,000.00. Section 2: That the City Council of the City of Huntsville determined that it would be in the best interest of the said City to pay for all of such equipment by an Equipment Acquisition Certificate of Obligation and that by virtue of the emergency condition no require- ment existed for the publication of notice of intention to issue such Certificate of Obligation and that by virtue of such past proceedings, that it is now proper and in the best interest of said City for the City Council to pass legislation creating said Certificate of Obligation as an obligation of said City, for the purpose of paying the purchase price for said sanitation equipment in the amount of $100,000.00.
