ORD CC 06/29/76 - HPD Removal of Vehicles• ORDINANCE NO. 76-9 AN ORDINANCE AMENDING SECTION 12-33, OF THE CODE OF ORDINANCES OF THE CITY OF HUNTSVILLE, TEXAS, BY AUTHORIZING ANY COMMISSIONED OFFICER OF THE HUNTSVILLE POLICE DEPARTMENT TO REMOVE CERTAIN PARKED OR STANDING VEHICLES, BY ADDING AN ADDITIONAL PARAGRAPH ESTABLISHING THE CONDITIONS UNDER WHICH A PARKED OR STANDING VEHICLE MAY BE REMOVED AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, THAT ARTICLE III, SECTION 12-33, OF THE STANDING, STOPPING, AND PARKING ORDINANCE OF THE CODE OF ORDINANCES OF THE CITY OF HUNTSVILLE IS HEREBY AMENDING BY ADDING NEW SECTION 16 CODE BOOK PAGE 101-103 AS FOLLOWS: Section 16: Any commissioned officer of the Huntsville Police Department is hereby authorized to remove any vehicle parked or standing in or on any portion of a street or highway when, in the opinion of said officer of the Huntsville Police Department, the said vehicle constitutes a hazard, or interfers with a normal function of any governmental agency, or by reason of any catastrophe, emergency or any unusual circumstance the safety of said vehicle. Any police officer of the City of Huntsville is hereby authorized to remove any vehicle parked or standing in or on any portion of a public roadway when, in the opinion of the said officer, the said vehicle constitutes a hazard, or interferes with a normal function of a government agency, or by reason of any catastrophe, emergency, or unusual circumstances the safety of said vehicle is imperiled.
