AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS,
CONFIRMING THE ACCEPTANCE OF CERTAIN BIDS FOR THE PURCHASE OF EQUIP-
MENT AND DETERMINING A NECESSITY THAT PAYMENT OF A PORTION OF THE
PURCHASE PRICE OF SUCH EQUIPMENT SHALL BE BY CERTIFICATE OF OBLIGA-
TION, DETERMINING THAT NOTICE HAS BEEN PUBLISHED AS REQUIRED BY LAW
THE INTENTION TO ISSUE SUCH CERTIFICATE OF OBLIGATION, AND OTHERWISE
CONFIRMING AND AUTHORIZING THE METHOD OF PAYMENT FOR SUCH EQUIPMENT.
WHEREAS, the City of Huntsville has heretofore advertised
and accepted a bid for the purchase of a backhoe loader to be used
in connection with City Water Departments operations; and,
WHEREAS, the City Council of the City of Huntsville has
heretofore officially determined that it would be in the best interest
of the City to purchase said equipment and that same is necessary to
provide for the public health and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF HUNTSVILLE, TEXAS:
Section 1: That the City of Huntsville confirms the
acceptance of a bid submitted by the following named company as the
successful bidder for the purchase by the said City of Huntsville of
a backhoe loader as follows:

John Deere 410 Backhoe Loader Heinz Equipment of
Conroe, Texas
AMOUNT OF BID
$ 17,581.11
ection 2: That the City Council of the City of Huntsville
determined that it would be in the best interest of the said City to
pay the sum of $ 7,581.11 cash for such equipment, and the balance
in the amount of $ 10,000.00 to be represented by an equipment
acquisition certificate of obligation and that notice of such intention
to issue such certificate of obligation has heretofore been published
in the official newspaper in the City of Huntsville, Texas, the
Huntsville Item, on November 23, 1975, and November 30, 1975, said
dates being within the time and in the manners as required by law and
that no objection or protest °has been filed in accordance with the law,
that it would be in the best interest of the City of Huntsville for
said City Council to pass legislation creating said certificate of
obligation as an obligation of said City, for the purpose of paying
the portion of the purchase price for said backhoe loader in the amount
of $ 10,000.00.
