ORD CC 06/24/75 - Sewer systemORDINANCE NO. 75 -9 AN ORDINANCE AMENDING CHAPTER 17, ARTICLE IV, OF THE CODE OF ORDINANCE OF THE CITY OF HUNTSVILLE, TEXAS, BY ADDING A NEW DEFINITION UNDER SECTION 17 -54 AND BY ADDING A NEW PARAGRAPH UNDER SECTION 17 -56, ENTITLED PROHIBITIVE DISCHARGES, TO BE NUMBERED PARAGRAPH (7) PROVIDING A PENALTY. WHEREAS the City Council of the City of Huntsville, Texas, heretofore on June 8, 1971, passed and published an amendment to Chapter 17 of the Code of Ordinances of the City of Huntsville which amendment was known as the Industrial Waste Ordinance of the City of Huntsville, which recited as the purpose of said ordinance the promotion of the public health and welfare by limiting discharges into the sanitary sewer system prohibiting 'discharges that would damage or interfere with the operation of the sanitary sewage treatment plant or that would be detrimental to the quality of effluent therefrom, and whereas, Section 17 -56 (6) prohibited the discharge of any noxious or malodorous substances, which paragraph covers and includes many substances; which, in the opinion of the City Council of the City of Huntsville, Texas, includes the dumping or discharging of septic tank systems waste, which waste in bulk may cause damage to the sanitary sewer system and increase the permissible level of effluent discharged from the sanitary sewer system, thereby endangering the system and the public health and therefore in the interest of the public health it is now deemed necessary to be specifically recited as a prohibited substance from being discharged into the sanitary sewer system or sanitary sewer plant and in pursuant thereof requires an amendment to the Industrial Waste Ordinance of the City of Huntsville. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Huntsville, Texas, that Article IV, of Chapter 17, of the Code of Ordinances of the City of Huntsville is hereby amended by the following additions to Section 17 -54 definitions, and Section 17 -56 prohibitive discharges with such amendments to be added as follows: Section 17 -54. Definitions. (z) Septic tank waste shall mean any liquid or solid substance pumped, drained or otherwise obtained or removed from septic tank systems. Section 17 -56. Prohibitive Discharges. (B) (7) Septic tank waste. BE IT FURTHER ORDAINED that any person, firm or corporation violating the terms of the amendments to the Industrial Waste Ordinance as set forth in this ordinance, shall, upon conviction, be deemed guilty of a Class C Misdemeanor and punished as described in Section 1 -8 of the Code of Ordinances of the City of Huntsville, Texas.
