AN ORDINANCE DETERMINING AND FIXING THE
MAXIMUM SCHEDULES OF RATES TO BE CHARGED
BY UNITED GAS, INC., ITS SUCCESSORS AND
ASSIGNS, IN THE CITY OF HUNTSVILLE, TEXAS,
FOR NATURAL GAS AND NATURAL GAS SERVICE
FURNISHED BY IT TO RESIDENTIAL AND COM-
MERCIAL CONSUMERS, CONTAINING DEFINITIONS,
FIXING THE EFFECTIVE DATES OF GAS RATES
PRESCRIBED IN THIS ORDINANCE, MAKING
MISCELLANEOUS PROVISIONS AND REPEALING
ALL ORDINANCES IN CONFLICT.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE:
SECTION 1. That United Gas, Inc., its successors and
assigns, is hereby authorized to place in effect the following
schedules of rates within the corporate limits of the City of
Huntsville, Texas (hereinafter called "City "), for the supply of
natural gas and natural gas service:
RESIDENTIAL RATES
Rate Schedule R- 173 -1, a copy of which
is attached, marked Exhibit "A ", and
made a part hereof.
COMMERCIAL RATES
Rate Schedule SC- 173 -1, a copy of which
is attached, marked Exhibit "B ", and
made a part hereof.
The above - described schedules of residential rates and of com-
mercial rates, as adjusted in the manner therein provided, are
the highest rates that may be charged by United Gas, Inc., its
successors and assigns, to residential consumers and commercial
consumers within the City. Other lower residential rates and
commercial rates may be fixed and determined from time to time
by United Gas, Inc., its successors and assigns, for gas and
gas service furnished to residential consumers and commercial
consumers within the City.
SECTION 2. That the terms "residential consumer" and
"commercial consumer" as used herein shall be defined as set
out in said Exhibits "A" and "B ", respectively.
SECTION 3. That natural gas supplied by United Gas,
Inc., its successors and assigns, is for the individual use of
the consumer at one point of delivery and shall not be resold
or shared with others.
SECTION 4. That the maximum rates and charges pre-
scribed in this ordinance for residential consumers and com-
mercial consumers shall apply as maximum rates and charges on
all bills rendered for gas and for gas service after the effec-
tive date of this ordinance, viz, the date of final passage
hereof.
SECTION 5. That all ordinances or parts of ordinances
in conflict herewith are hereby repealed to the extent of
the conflict only.
SECTION 6. That nothing contained in this ordinance
shall be construed as in any manner, now or hereafter, limiting
or modifying the right and power of the City, under the law,
to regulate the rates charged by United Gas, Inc., its suc-
cessors and assigns, within the City.
