ORD CC 03/13/73 - Garbage CollectionORDINANCE NO. AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, DETERMINING THE NECESSITY FOR THE ACQUISITION OF CERTAIN GARBAGE COLLECTION EQUIPMENT; DETERMINING THE CITY SECRETARY HAS PUBLISHED NOTICE OF SAID INTENTION AND DETERMINATION; AND DECLARING AN EMERGENCY. WHEREAS, the opportunity has been presented to the City of Huntsville to acquire certain garbage collection equip- ment for its public purposes; and WHEREAS, the City Council of the City of Huntsville, hereby officially determines that it would be in the best interest of the City to purchase said certain garbage collection equipment. NOW, THEREFORE, BE IT ORDAINED BY THE City Council OF THE CITY OF HUNTSVILLE; SECTION 1: That the City of Huntsville hereby intends to purchase certain garbage collection equipment, and to adopt an ordinance authorizing the issuance of interest bearing Cer- tificates of • Obligation of the City in an amount not-to exceed- 86,000.00for such purposes, after the advertisement for bids on said equipment as prescribed by law, and more particularly described as follows: Quantity 1 1 Type Number Descri tp ion Engine No. 1973 C 900 series C90KVR31793 Ford Truck Front loading compaction body and loader 86 DP45 -25C 2 Cubic yard low containers 20 DP45 -25C 3 Cubic yard low containers 79 DP45 -25C 4 Cubic yard low containers 42 DP45 -25C 6 Cubic yard universal type containers 9 DP45 -25C 8 Cubic yard universal type containers SECTION 2. That the City Council of the City of Huntsville, Texas hereby determines that the City Secretary has heretofore published notice of said intention in the City's official newspaper, The Huntsville Item, on the 10th day of December, 1972, and on the 17th day of December,. 1972. e • SECTION 3. That the public importance of this measure and the fact that it is to the best interest of the City to acquire the equipment as set out above at the earliest possible date, for the immediate preservation of the public peace, property, health, and safety of the City and its citizens, creates an emer- gency and thus necessitating that the rule requiring ordinances to be read at two meetings of the City Council, one of such meetings being a regular meeting, be suspended and said rule is hereby suspended, and this Ordinance shall take effect and be in force from and after its passage and approval and it is so ordained.
