ORD CC 05/07/63 - Parking Meter Zonei • AN ORDINANCE OF THE CITY OF HUNTSVILLE, TEXAS, AMEND- ING THE CODE OF ORDINANCES BY ADDING A SECTION TO BE NUMBERED SEC. 12 -64, TO ESTABLISH A PARKING METER ZONE TO INCLUDE A PUBLIC PARKING LOT OPERATED BY THE CITY OF HUNTSVILLE, TEXAS, AND TO PROVIDE THE REGULATION THEREOF AND PENALITIES FOR VIOLATION. Be it ordained by the City Council of the City of Huntsville: That the code of ordinances of the City of Huntsville, Texas, shalt be hereby amended by adding a section to be numbered Sec. 12 -64, which said section reads as follows: SEC. 12 -64 (a) In addition to the area designated in Sec. 12 -50 as the parking meter zone, there is hereby designated as a parking meter zone, the public parking lot described as follows: All of a certain lot or parcel of land being situated in the City of Huntsville, County of Walker, State of Texas, be- ing parts of Lots 11 and 12 in Block No. 3, according to the map and plan of said City of Huntsville, and being described by metes and bounds as follows, to -wit: BEGINNING at the intersection of the north Line of 12th Street, with the east Line of Avenue M, a stake for corner; THENCE North with the said East line of Avenue M 125 feet to a stake for the Southwest corner of a lot or parcel of Land, also Located in said Block No. 3, presently leased to Humble Oil & Refining Company; THENCE East 100 feet to the Southeast corner of the said Humbel Oil & Refining Company lot, a stake in the West Line of a lot or parcel of land, also located in said Block No. 3, pre - sently Leased to J. N. Scarborough; THENCE South 15 feet to a stake for the Southwest cor- ner of the said Scarborough lot; THENCE East with the lower South Line of the said Scar- borough lot 35 feet to a stake for corner; THENCE South 110 feet to a stake for corner in the said North line of 12th Street; THENCE West with the said North line of 12th Street 135 feet to the place of beginning. • • -2- (b) The Mayor is hereby authorized to cause parking spaces to be designated, maintained, and marked off in and on said public parking lot. The fact that a parking space is designated by lines or marks painted on the surface of the public parking lot shall be prima facie evidence that the mayor was authorized by the City Council to designate the same at the place it is Located and no vehicle shall be parked on said public parking lot except in the space designated by the marks on the surface thereof for parking vehicles. (c) The City Council is hereby authorized to cause to be installed and maintained parking meters in and on such parts of the public parking lot abutting the space provided for the parking of vehicles thereon, and shall be so set as to show or display a signal showing whether the parking space is or is not legally in use. Each parking meter shall be installed and set to display, upon the deposit therein of one or more coins of the United States of America, a signal indicating legal parking for that period of time conforming to the limit of parking time charged therefor as indicated by the required coins specified on the meter. Each parking meter shall also be so arranged, that, upon the expiration of such legal parking time, it will indicate, by a mechanical operation, a proper sign, that the lawful parking period indicated on the meter has expired. (d) Every vehicle parked in or on the public parking lot shall be parked clearly within the space provided for the parking of a vehicle with the front of the vehicle directed toward the parking meter next to such park- ing space and as near to the meter as the barrier or curb in front of the meter is installed. (e) When any vehicle shall be parked in the space provided for the parking of vehicles, the operator of such vehicle shall, upon entering the marked parking space, immediately deposit one or more coins indicated on the meter of the United States of America, in a slot made therefor in the parking meter, and the parking meter space shalt then be used by such vehicle during the parking time limits for which such deposited coin or coins is payment as indicated on the meter. If the vehicle shalt remain parked in any such parking space beyond the parking time Limit for which such deposited coin or coins is payment, the parking meter shall display a sign showing overtime or illegal parking, and in that event, such vehicle shall be considered as parked over time and beyond the period of time for which payment has been made. Such over time parking of a vehicle shall be unlawful and a violation of this ordinance. (f) It shall be unlawful for any person to cause, allow, let, permit or suffer any vehicle registered in his name or owned or operated by him or under his possession or under his control, to be or remain in any park- ing space next to which a parking meter is placed while the meter is dis- playing a signal showing that such vehicle shall have parked for a period of time for which payment has not been made by deposit of a coin or coins in the parking meter, without paying, within 24 hours a charge of 25 for each hour or fractional part thereof when such vehicle shall remain white the r • • -3- parking meter shows a signal that no coin or coins has been deposited for the time during which such vehicle is so parked, to the City. The display of a signal by the parking meter showing illegal parking white a vehicle is parked in the space provided for parking adjacent or adjoining such meters shall be prima facie evidence that the vehicle has been parked for a time for which no coin or coins has been deposited in the meter, (g) The provisions of this section shall apply on aLL days except Sundays and holidays and shall be effective on Saturdays from 8:00 o'clock A. M. to 8:00 o'clock P. M. and on week days from 8:00 o'clock A. M. to 6:00 o'clock P.M., and shall apply to the public parking Lot described in sub - paragraph (a) hereof. (h) It shall be unlawful for any person to deface, injure, tamper with, open or willfully break, destroy or impair the usefulness of any parking meter installed under the provisions of this ordinance. (i) Any person who shall be found guilty of a violation of this ordi- nance shall be guilty of a misdemeanor. On motion duly made and unamiousty approved at a regular meeting of the City Council of the City of Huntsville, Texas, the above and foregoing ordinance was passed this 7th day of May, (963, ATTEST: SECRETARY
