Ordinance 2016-16 - Ord. 2016-16 - Establishing one-way designations for Bobby K. Marks & 16th Street, 5-3-16 ORDINANCE NO. 2016-16 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, AMENDING CHAPTER 44, TRAFFIC AND MOTOR VEHICLES, OF THE CITY OF HUNTSVILLE CODE OF ORDINANCES BY AMENDING CERTAIN SECTIONS AS SET OUT BELOW; SETTING A PENALTY; AND MAKING OTHER FINDINGS AND PROVISIONS RELATED THERETO; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. WHEREAS, the Huntsville Code of Ordinances ("Code"), Chapter 44 governs traffic and motor vehicles; and WHEREAS,the City of Huntsville, a home rule municipality, is authorized by Charter to adopt and implement necessary and reasonable ordinances in the best interests of its citizenry; and WHEREAS, the City council of the City of Huntsville finds the provisions of this ordinance set forth below are necessary to protect the health, safety, and welfare of its citizens and the public, and said rules and regulations are reasonable; i i NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE,TEXAS,THAT: Section 1. The facts and matters set forth in the preamble of this Ordinance are found to be true and correct and are hereby adopted, ratified, and confirmed. Section 2. That Chapter 44, Traffic and Motor Vehicles", Article VIII, Section 44-192, Schedule I is amended as set out in Exhibit A attached hereto and incorporated b for all iP Y purposes by changing the direction of traffic for two streets: Street Restriction Bearkat Boulevard(from University Avenue to Bobby K Marks Drive ) Eastbound only Bobby K Marks Drive (from Bearkat Boulevard to Bowers Boulevard) Southbound only Section 3: All appropriate amendments to traffic signs and striping, meeting Texas Manual on Uniform Traffic Control Devices(TxMUTCD)requirements,will be placed to provide only 1-Way traffic movements for the two streets identified in Section 2. Section 4: The City Manager is authorized and directed to cause the placement of proper signs along the above described streets. Section 5: After completion and installation of all necessary signage and pavement striping, it shall be unlawful and an offense for a driver of a vehicle to disobey the instruction of the signs placed in accordance with the provisions of this ordinance, and said offense shall be punishable as set out in Chapter 44,Article I, Section 44,unless at the time otherwise directed by a Police Officer. �I Section 6: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect any of the remaining provisions of this ordinance. Section 7. All ordinances and parts of ordinances in conflict with the provisions of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing I the subject matter covered by this ordinance. Section 8: The City Secretary shall publish the caption of this ordinance in the official City newspaper at least twice before the ordinance becomes effective.
