Y AN ORDINANCE AUTHORI7ING THE MAYOR TO EXECUTE AND THE CITY SECRETARY TO ATTEST A DEED RECONVEYING TO GIBBS B= OTHERS & COINTANY A CERTAIN LOT OR PARCEL OF LAND WITHIN THE CORPORATE LI'P'ITS OF THE CITY OF HUNTSVILLE, TEXAS, TOGETHER WITH EASEMENT RIGHTS UPON ADJOINING LOT, THAT WERE DEEDED TO THE CITY OF HUNTSVILLE BY SAID GIBBS BROTHERS & COMPANY FOR THE PURPOSE OF DRILLING AND MAINTAINING A WATER WELL WHICH HAS BEE:" FOUND TO BE USELESS FOR THAT PURPOSE AND FOR WHICH THE CONSIDERATION HAS NOT BECN PAID. WHEREAS, the City of Huntsville entered into an agreement to purchase from Gibbs Brothers & Company a certain lot or parcel of land within the corporate limits of the City of Huntsville, together with easement rights upon adjoining lot, for the purpose of drilling and maintaining a water well and line; and WHEREAS, it has been determined that said property is useless for the purpose for which it was intended and has been abandoned as such by the City of Huntsville; and WHEREAS, the consideration for said lot has not been paid by the City of Huntsville to the said Gibbs Brothers & Company, and the City Council deems it advantageous and to the best interest of the City to reconvey said property and easement rights to said Gibbs Brothers & Company in lieu of the payment of the consideration therefor: Therefore BE IT ORDAINED by the City Council of the City of Huntsville, Texas in regular assembly this the 7th day of August 1951, that: Section 1: The Mayor is authorized and directed to execute a deed and relinquish of easement rights and the Secretary of the City of Huntsville to attest the same reconveying to Gibbs Brothers & Company, a partnership firm, of Walker County, Texas, all that certain lot and premises and the easement mentioned and described in that certain deed from Gibbs Brothers &. Company to the City of Huntsville, Texas dated July 11th, 1951 and recorded in Volume 137 page 313 of the Deed Records of Walker County, Texas wherein said lands and easement are more fully described by metes and bounds, which said deed and conveyance shall be in lieu of and in cancellation of the consideration contemplated for said deed from Gibbs Brothers & Company to the City of Huntsville, Texas.
