RESO 2011-18 - Annexation Public HearingRESOLUTION SETTING A PUBLIC HEARING ON A PROPOSED ANNEXATION RESOLUTION NO. 2011-18 A RESOLUTION SETTING A DATE, TIME, AND PLACE FOR A PUBLIC HEARING ON THE PROPOSED ANNEXATION OF CERTAIN PROPERTY BY THE CITY OF HUNTSVILLE, TEXAS, AND AUTHORIZING AND DIRECTING THE MAYOR TO PUBLISH NOTICE OF SUCH PUBLIC HEARING. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS: SECTION 1. On the 6th day of September, 2011, at 6 o'clock p. m. and on the 20th day of September, 2011, at 6 o'clock p.m. in the City Council Chambers of City Hall of the City of Huntsville, Texas, the City Council will hold a public hearing giving all interested persons the right to appear and be heard on the proposed annexation by the City of Huntsville, Texas of the following described property, to -wit: PROPOSED ANNEXATION 74.00 TOTAL ACRES (3 Tracts) FIELD NOTES Tract No. 1 Being 1.91 acres of land, more or less, situated in the WARREN BIRDSELL LEAGUE, A -6, Walker County, Texas, and being out of and a part of the called 219 acre "First Tract" conveyed by J.H. Thomason and wife, Marguerite Thomason, and Mabel S. Eastman to Horace Smith and wife, Alverta Smith, by deed dated March 22, 1940, and recorded in Volume 94, Page 190, Walker County Deed Records, said 1.91 acres being described by metes and bounds as follows: BEGINNING at an angle point in the south line of said 219 acre tract, same being the northwest corner of the called 71.0 acre "Second Tract" conveyed by J.M. Thomason and wife, Marguerite E. Thomason, and Mabel S. Eastman to Horace Smith and wife, Alverta Smith, by deed dated March 22, 1940, and recorded in Volume 94, Page 190, Walker County Deed Records; THENCE N 89 °37'W with said south line of 219 acre tract, 715.8 feet to an iron rod for the southwest corner of the same, said point being an angle point at the southeast corner of a county road; THENCE N 00 °37'W with the east line of said county road and the west line of said 219 acre tract, 60.0 feet to an iron rod for a corner; THENCE S 89 °37'E, 717.1 feet to an iron rod for an angle point; THENCE S 89 °59'E, 667.5 feet to an iron rod for corner; THENCE SOUTH 60.0 feet to an iron rod in the north line of said 71.0 acre tract and the south line of said 219 acre tract; THENCE N 89 °59W, with said division line of 71 acre tract and 219 acre tract, 668.1 feet to the POINT OF BEGINNING. Tract No. 2 Being 24.04 acres, more or Tess, situated in the WARREN BIRDSELL LEAGUE. A -6, Walker County, Texas and being out of and a part of the called 71 acre "Second Tract" conveyed by J.H. Thomason and wife, Marguerite E. Thomason, and Mabel S. Eastman to Horace Smith and wife, Alverta Smith, by deed dated March 22, 1940, recorded in Volume 94, Page 190, Walker County Deed Records, said 24.04 acres being described by metes and bounds as follows: BEGINNING at the northwest corner of the herein described 24.04 acre tract, same being the northwest corner of said 71 acre tract, said point also being in the south line of a called 219 acre tract referred to as the "First Tract"; THENCE S 89" 59' E with the division line between "First Tract" and the "Second Tract", 6081 feet to an iron rod for a corner; THENCE South, 1,567.4 feet to an iron rod for corner in the south line of said "Second Tract"; THENCE VVea, with said south line of the "Second Tract" 668.1 feet to an iron rod for the southwest corner of the same; THENCE North with the west line of said "Second Tract", 1,567.6 feet to the Point of Beginning. Tract No. 3 Being 48.06 acmse, more or less, situated in the, WARREN BIRDSELL LE8GUE, A-O, Walker County, Tmwao, and being out of and a part of a called 219 acre "First Tract" and a called 71 acre "Second Tract", conveyed by J.H. Thomason and wife, Marguerite E. Thomason, and Mabel S. Eastman to Horace Smith and wife, Alverta Smith, by deed dated March 22, 1040. recorded in Volume 94, Page 190, Waker County Deed Records, said 48.05 acres being described by metes and bounds as foliows: BEGINNING at a concrete monument at the southeast corner of the "First Tract", the northeast corner of the "Second Tract" and the west line of the City of Huntsville airport property; THENCE S 00 0 0 4'E. along the division line between said airport property and the "Second Tract" 1,566.9 feet to a concrete monument at the southeast corner of said 71 acre "Second Tract"; THENCE WEST along the south line of said Second Tracr, 1,278.9 feet to an iron rod for corner; THENCE NORTH, 1,627.4 feet to an iron rod for corner; THENCE N 89°05'E, 1,290.09 feet to an iron rod set in the east line of said "First Tract" and the west line of said City ofHuntsvi]|e airport property; THENCE S 09°28W, along said dilAsion line between the "First Tract" and airport property, 82.1 feet to the POINT OF BEGINNING. SECTION 2. The Mayor of the City of Huntsville is hereby authorized and directed to cause notice of such public hearing to be published once in a newspaper having general circulation in the city and in the above described territory not more than twenty days nor less than ten days prior to the date of such public hearing, in accordance with the Municipal Annexation Act. The land is currently vacant and is located next to the airport property. Background: Upon a petition for annexation, it is required that two (2) public hearings be held to receive comments on the petition for annexation. After the public hearings, an ordinance annexing the territory will be considered at a subsequent meeting. The public hearings will be held at the regular Council meetings on September 6 and 20, 2011 with the ordinance considered on October 11, 2011 Facts to Consider: • This resolution only sets the dates of the public hearings • A service plan for provided municipal services to the annexed area will be provided prior to the public hearings • After the two public hearings, an ordinance for annexation will be considered Fiscal Impact/Funding Source(s): None at this time. No cost of providing services to the area is expected.
