A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, ENDORSING AND PROVIDING ASSURANCES ON THE FUNDING OF REQUIREMENTS OF THE CITY’S INDUSTRIAL PRETREATMENT PROGRAM.
WHEREAS the U. S. Environmental Protection Agency (EPA) has promulgated regulations (Pretreatment Regulations) pursuant to the Federal Water Pollution Control Act (i.e., Clean Water
Act), which establish mechanisms and procedures for enforcing National Pretreatment standards controlling the introduction of wastes from non-domestic (i.e., industrial) sources into
Publicly Owned Treatment Works (POTW) such as the City of Huntsville’s A. J. Brown WWTP, N. B. Davidson WWTP and Robinson Creek WWTP; and
WHEREAS the Texas Commission on Environmental Quality (TCEQ) has promulgated regulations which incorporate by reference EPA’s Pretreatment Regulations; and
WHEREAS the City of Huntsville has developed, pursuant to the Federal Water Pollution Act (i.e., Clean Water Act), an industrial pretreatment program approved by EPA and TCEQ; and
WHEREAS such Pretreatment Regulations, City of Huntsville Code of Ordinances Section 46 and Texas Pollutant Discharge Eliminations System (TPDES) Permit No. 10781-002 issued to the City
of Huntsville by TCEQ for the N. B. Davidson WWTP require the City of Huntsville to update such industrial pretreatment program as necessary; and
WHEREAS the TCEQ has mandated certain changes to the City’s Industrial Wastewater Ordinance, Section 46, program policy and procedures, industrial user surveys, monitoring program, inspection
manual and forms, and specific limitations on wastewater discharge, and pursuant to 40 Code of Federal Regulations, Section 408, requires that assurances be provided concerning the
funding of this program and mandated changes; and
WHEREAS City Council held a public hearing on the updates to the industrial pretreatment program on February 16th, 2010, for which notice was published in the newspaper on February 1st
and 8th, 2010;
WHEREAS City Council has implemented or fully supports and endorses all the program elements; and
WHEREAS notice of the agenda for this meeting, was given in accordance with law by posting the same at the place reserved and designated for notices of public meetings and public activities
and prior to the adoption of this resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, that:
SECTION 1: The findings and declarations contained in the preambles of this Resolution are incorporated herein as part of this Resolution.
SECTION 2: The City’s updated industrial pretreatment program is fully supported and endorsed by City Council, and the City has implemented or is in the process of implementing all the
program elements contained therein.
SECTION 3: This resolution shall take effect from and after its passage, and it so resolved.
