A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HUNTSVILLE, TEXAS AUTHORIZING SETTLEMENT OF LAWSUIT,
AMERICAN GENERAL FIRE AND CASUALTY, OVER CONSTRUCTION
OF SANITARY SEWER LINE FOR A SUM NOT TO EXCEED $5,000,
AND PROVIDING FOR THE EFFECTIVE DATE HEREOF.
WHEREAS, American General Fire and Casualty Company
has filed suit against the City of Huntsville to recover
amounts expended on a performance bond on a sewer con-
struction contract with the City; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF HUNTSVILLE, TEXAS THAT:
Section 7: The City Attorney and /or City Manager
are hereby authorized to settle said lawsuit for a cash
settlement not to exceed $5,000 upon receipt of a release
or execution of judgment absolving the City from any and
all liability with regard to the actions made the basis
of said suit.
Section 2: This resolution shall take effect
immediately from and after its passage by City Council.
Passed on this 27th day of May, 1980 by affirmative
vote of the City Council of the City of Huntsville, Texas.
