Letter of ineligibility, 8-22-18 August 22, 2018 Mr. Ricardo “Rico” J. Rodriguez 1304 10th Street Huntsville, Texas 77320 Dear Mr. Rodriguez: The City is supplying this letter per the requirements of the Texas Election Code (EC) Section 141.032(e) If an application does not comply with the applicable requirements, the authority shall reject the application and immediately deliver to the candidate written notice of the reason for the rejection. As noted on the SoS website, effective September 1, 2015, House Bill 484 amended the Texas Election Code Section 141.001 to provide a new general rule…that a candidate must be a registered voter of the territory elected from as of the filing deadline. The Texas Secretary of State’s (SoS) office has notified us that they have no record of your being a registered voter in the state, which also precludes your being a registered voter in the City of Huntsville. As of yesterday afternoon, SoS noted that “Our review of the voter registration database reflects that the candidate, Mr. Rodriguez, is not currently registered to vote in Texas. It appears he submitted a voter registration application to the county yesterday which was not complete.” Due to the response from the SoS regarding your voter registration, the City cannot declare you as an eligible candidate to be printed on the November 6, 2018, general election ballot and must notify you of the rejection of the ballot application. The SoS did note that voter registration requirements differ for write-in candidates and suggested that you may wish to review those and consider that option.
