A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HUNTSVILLE, TEXAS, URGING THE TEXAS MUNCIPAL LEAGUE TO
CONSIDER AND ADOPT A RESOLUTION RELATING TO THE
CONSOLIDATED FARM AND RURAL DEVELOPMENT ACT (7 U.S.C.
SECTION 1926); AND MAKING OTHER PROVISIONS RELATED
THERETO.
WHEREAS a Water Supply Association, without notice to the City, established water service in
the City and its planning area, and in much of its service area, provides such service
without legal authority (a certificate of convenience and necessity) to serve many of
such areas from the State of Texas; and
WHEREAS the Water Supply Association has applied for a broad geographic CCN to obtain the
exclusive rights to serve water to over two - thirds of Walker County, including areas
in the City and its planning area and areas in which the City has water supply and
distribution capabilities and contracts to serve water; and
WHEREAS under the umbrella of 7 USC section 1926 (the Consolidated Farm and Rural
Development Act), the Water Supply Association has sued in federal court to enjoin
the City from participating in State administrative proceedings regarding the
Association's application for CCN; and
WHEREAS City Council believes these circumstances threaten the econonomic health and well
being of the Community; and
WHEREAS similar, or more egregious, situations are facing cities across the State of Texas;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
HUNTSIVLLE, TEXAS, that:
The City Council directs its Mayor and staff to present a resolution in substantially the same form
as attached for consideration by the Texas Municpal League at its annual convention, and that the
Members of the League are requested and encouraged to adopt the Resolution, and act accordingly.
