RESO 1999-05 - Abandon GSU easementRESOLUTION NO. 99-05 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, APPROVING THE ABANDONMENT OF A CERTAIN STORM SEWER EASEMENT, GULF STATES UTILITY EASEMENTS, UTILITY, ACCESS AND DRAINAGE EASEMENT, AND SANITARY SEWER EASEMENT; AUTHORIZING THE MAYOR TO EXECUTE THE REQUIRED INSTRUMENTS TO EFFECTUATE THE ABANDONMENT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, JEFCO Development Corporation has filed a plat for Parkwood Square, a Replat of West Hill Park, Section 3 which necessitates the abandonment of certain easements in return for the granting of new easements to the City; and WHEREAS, some of the easements with the Final Plat of West Hill Park, Section 3 were dedicated through the platting process and others were dedicated by a separate metes and bounds instrument; and WHEREAS, the City Council desires to abandon certain easements in return for the dedication of new easements as shown on the Final Plat of Parkwood Square, a Replat of West Hill Park, Section 3; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS: SECTION 1: That the Storm Sewer Easement as described in Exhibit 1 attached hereto and incorporated herein; the City of Huntsville's interest, if any, in the Gulf States Utility Easements as described in Exhibit 2 attached hereto and incorporated herein; and the Utility Easement, Access and Drainage Easement as described in Exhibit 3 attached hereto and incorporated herein; and a Sanitary Sewer Easement as described in Exhibit 4 attached hereto and incorporated herein are hereby abandoned, quitclaimed, and released by the City of Huntsville, Texas, and the Mayor of the City of Huntsville, Texas is authorized to execute on behalf of the City of Huntsville all instruments necessary to effectuate this abandonment. The Mayor of the City of Huntsville, Texas, is also authorized to abandon, release, and quitclaim those easements shown in the Final Plat of West Hill Park, Section 3 as recorded in Volume 3, Page 170 of the Plat Records of Walker County, Texas, in return for the dedication of easements in the Final Plat of Parkwood Square, a Replat of West Hill Park, Section 3.
